Sylvia J. v. Transit Authority of River City (TARC) – January 2003 – Jefferson Circuit Court, Case No. 01-CI-03945The case settled for $125,000. This was awarded to a 60-year-old woman who was working as a professor at Jefferson Community College. As Sylvia was crossing Broadway at the Fourth Street intersection, she was struck by a TARC bus that was making a left-hand turn. The pedestrian was treated on the scene by EMS for head trauma. Tests revealed that she suffered from head contusions, swelling and hemorrhages as a result of the accident. The accident caused issues with short-term memory and organizational skills. The case was complicated by an extremely high blood alcohol level of the woman that placed the fault of the accident in question. There was also a question as to whether Sylvia was in the crosswalk at the time of the accident and whether she had the right-of-way at the time.
