Kentucky Enacts Text Messaging Law

Kentucky Governor Steve Beshear signed the Cell Phone Text Messaging Bill into law on April 25, 2010. Drivers under the age of 18 are strictly prohibited from talking or texting on a cell phone while driving.  The prohibition is applicable to drivers who have an instruction permit, intermediate license or a full operator's license.  There is an emergency exception to summon medical help, law enforcement or a public safety agency. 

            Those drivers over the age of 18 cannot write, send or read a text-based communication such as text message, instant message or electronic mail while operating a motor vehicle.  My understanding is that there will be warnings issued on violations until January 1, 2011. 

            First time offenders will be fined $25.00.  Second and subsequent  offenders will be fined $50.00.
Court costs will also be assessed. It has also been reported that the police will only be issuing warnings until January 1, 2011.
