Toll Cheat? New Jersey is coming for you

Driving recklessly through a toll plaza without paying presents a serious risk for a car accident. Other drivers choosing to obey the rules are either idling or traveling slowly through the area. Even the slightest movement could cause a catastrophic accident leading to life-threatening injuries for all involved. Responsible drivers end up paying extra as tolls on the Garden State Parkway or New Jersey Turnpike increase to compensate for drivers who choose to shirk toll road obligations. New Jersey car accident attorneys know reckless drivers causing accidents can be held liable for damages incurred by those injured as the result of their actions.
Changing New Jersey Policies
So why take the risk? Because up until now, New Jersey’s enforcement policies regarding toll cheats has been all but toothless. That could all change thanks to a new pilot program enacted by the state Motor Vehicles Commission, according to NJ.com.
The New Jersey Turnpike Commission is shelling out $35,000 to the NJ Motor Vehicles Commission to head a program designed to suspend the registrations of drivers who owe toll road fees in excess of $1,000. The fine for parking or moving an unregistered vehicle in New Jersey is $54 per violation. These violations, along with a lack of registration, could potentially lead to dropped auto insurance coverage and possible license suspensions. It’s easy to see the domino effect that can occur from simply failing to pay tolls.
Total Outstanding Toll Fees
The New Jersey Turnpike Authority estimates the total outstanding bill for all toll cheats in the state is $2.5 million. Sustaining injuries in accidents involving those who choose not to pay these fines may mean NJ injury lawyers will have to sue the drivers directly to recover damages as opposed to suing to access driver insurance policies. With all that hypothetically stacked against these drivers, it makes good sense to pay the fines and avoid the serious consequences that could arise.

Rain Mowery, 6, has made a full recovery, and Rain’s younger sister Alyssa, was in extreme critical condition, but she pulled through and has since made huge strides to recovery.
After weeks being in critical condition, and months in a rehab center, Alyssa is now doing things like running and jumping on her own. She does still have obstacles. She has fluid in her brain. Her head injury was so severe it has caused learning challenges, hyperactivity, and memory loss. She has returned to kindergarten, but needs special attention.
Her improvements give her parents hope that she will have a full recovery.
Las Vegas Attorney, Richard Harris is happy to see improvements to the street where she was hit are also being made. The city of North Las Vegas will be installing flashing lights at the intersection to better alert drivers. Crosswalk safety is the responsibility of the drivers and the pedestrians. Hopefully these improvements will result in a safer Las Vegas.
A lot of attention has been made because of the amount of auto-pedestrian accidents so far this year.
Forty-seven students in Louisville, Kentucky were on a Jefferson County Public Schools bus No. 0229 that was heading to Breckinridge-Franklin and Chenoweth Elementary Schools when it T-boned a 4-door Chevy Malibu. The accident happened at around 9 a.m. last Thursday (February 23, 2012) in the intersection of E. Chestnut Street at E. Liberty Street near the Phoenix Hill neighborhood. According to Lauren Roberts, a JCPS spokesperson, the bus was heading south on Chestnut when witnesses told JCPS transportation officials and Louisville Metro Police that the car ran a red light and was struck broadside by the bus in the intersection.

The woman driving the Chevy Malibu was taken to Norton Hospital and the extent of her injuries was not known. The bus driver was not injured. Sixteen students from the bus complained of pain and were taken to Kosair Children’s Hospital by EMS for treatment. Most of those injuries are said to be bumps, bruises and sore necks. While those uninjured students were transferred to another bus and taken to school.

Student Davon Ashby relayed that his head hit the seat when the bus driver stopped to break real fast. He added that this was his first time being in a car wreck and he got really scared. He and some of the students were released from Kosair Children’s Hospital later on Thursday and the rest are expected to be fine. Metro Police say no charges are expected to be filed against the driver of the car.

As a personal injury attorney I have been asked who pays for injuries in a case like this. Medical bills from these injuries will be paid by the automobile insurance of the parent of the student. This is under their PIP or Personal Injury Protection portion of their policy. I have also found in these cases that the insurance policy of the at-fault car is insufficient. Most of the injured will have to look to their parents underinsured motorists policy for adequate compensation.

Despite the danger of bites or attacks from dogs, they still have positive traits that we love. Senator George Graham Vest gave a beautiful and emotional closing argument of man’s best friend. He won the court battle and the hearts of dog lovers through his “eulogy to the dog”, which is what has his closing argument in the Old Drum case during the 1870 came to be known as. His words have stood the test of time and remain special to the hearts of dog lovers. He pointed out how a dog’s existence changed a man’s life.
Clark Memorial Bridge in Louisville, Kentucky was shut down for about three hours Wednesday evening, January 25th due to the investigation of a pedestrian-bicycle-car injury accident. MetroSafe and Jeffersonville Police received calls at around 6:15 about a pedestrian, Michael Amick, who had been struck on the bridge.

Jeffersonville Police Department Detective Todd Hollis said a bicyclist and pedestrian were traveling in opposite directions on the sidewalk on the east side of the Clark Memorial Bridge. The bicyclist was headed northbound and hit a woman who was walking southbound toward Louisville. Due to the collision, the woman fell into the roadway where she was struck by a Mitsubishi Eclipse. The driver of the vehicle called 911 for help.

The pedestrian was transported to University Hospital in Louisville with serious head injuries. No other injuries were reported in this accident. The bicyclist and driver of the vehicle were tested for impairment as a standard in crashes resulting in serious injury. Hollis said that there was no indication that the either was impaired. They are not expecting to file charges against them.

As a personal injury attorney, one should not take risk on walking or bicycling on roadways especially during at night unless you will be wearing bright or reflective clothing. There is a bicycle lane on the bridge that the bicyclist should have been using. I hope and pray for the pedestrian that she will have a fast recovery and her injuries will not be life-threatening. It is so important for us to be alert at all times and be safe on our Kentucky roads.

Insurance coverage should be available to cover the injuries the pedestrian sustained. Even thought there is no fault on the car that hit the pedestrian the vehicle's PIP insurance should pay the first $10,000.00 of medical bills. As for pain and suffering the pedestrian will look to any insurance the bicyclist had as well as there own policies.

The Impulse Adjusting Instrument

In-depth research and advancement of technologies makes our lives better. Nowhere is this more evident than in the field of medicine. New inventions of medical instruments have provided better quality care to many Kentucky car accident victims. The Impulse Adjusting Instument is one of those advancements.

Our body has millions of nerves that control the function and physiology of our body. Once our spinal joints are misaligned or not moving the right way, it can irritate our nerves and can affect our health. These nerves notify our brain that something is wrong and we experience pain, stiffness, soreness and feel tired. Chiropractic care finds the source of the pain and targets the cause and prevents the problem from recurring.

In Chiropractic field, advanced technology is available to deliver chiropractic adjustments. The Impulse Adjusting Instrument has been developed by more than a decade of research and engineering. It features a new wave of technology tuned in to the natural frequency of the body. This is thought to lead to more effective and efficient Chiropractic Adjustments. This patented and FDA registered device was produced to provide gentle and precise chiropractic adjustments to the joints of the spine and extremities to relieve pain and bring back body’s balance and function. It is controlled by micro-computer circuitry placed within the device that delivers a controlled force that chiropractors can use to treat different areas of the body.

A chiropractic adjustment with the Impulse Adjusting instrument is safe and effective for patients of all ages. A light tapping sensation will be felt on the area that is being treated. Treatment is painless in most cases and patients reported improved mobility, soothing feeling and relief of pain after the adjustment. Results may vary depending on the case and chronic conditions of patients.

As Kentucky personal injury attorney I am always interested in new treatment methods and procedures that will help car accident victims. This new innovation will improve the condition of patients, including car accident victims. This type of adjustment is better for some people.

I experienced the impulse adjusting instrument first hand at Dynamic Chiropractic and was impressed by the result. To be honest I thought it was a gimmick that would give me no relief. All I can say is “I was wrong”. The Impulse Adjusting Instrument will help car accident victims suffering from neck and back pain.

Facebook is influential and useful in connecting with friends and other people

Facebook has become a big issue in auto accident and all personal injury cases. On October 27, 2011, a decision was handed down by New York Appellate Court on Russell Patterson v Turner Construction Company, et al. The court held that a defendant in a personal injury case does not have an unfettered right to access the plaintiff’s Facebook account. The defendant can only discover that which is “relevant, in that it contradicts or conflicts with plaintiff’s alleged restrictions, disabilities, and losses, and other claims.” The appellate court reversed a trial court order which “granted defendants’ motion to compel an authorization for all of plaintiff’s Facebook records compiled after the incident alleged in the complaint, including any records previously deleted or archived"

As a Kentucky Personal Injury Attorney, I am also a user of Facebook and I find it useful in checking on defendants in cases I am involved in. It is also an outlet to share relevant information and blog posts visible to everyone interested. In personal injury cases, I have advised Kentucky accident victims to avoid posting, discussing or commenting about anything regarding the accident. Any posts or updates may be useful to insurance company to deny any accident claim

As Facebook becomes intensely widely utilized, let us all remember that people needs to be extra careful in posting in this site. Roseberry, 22, was charged with driving under the influence.

Jones left the scene in fear of an altercation with the other driver but was later questioned by police before being treated at the hospital while Poole was questioned at the scene and was taken to UK hospital. They suffered non-life threatening injuries, experienced minor neck and back pain after the car accident.

Warren relayed how frustrated they were and screamed right after the accident happened, “Look what stupidity can bring you when somebody’s drinking and driving. That’s how quickly we could lose our lives.” He then said following the accident, "Looking back on it, I won't say we made a bad choice, but I could say we'll probably think twice before we make decisions to go out." And Jones posted on his Twitter page following the accident, "Thanking god for blessing me to live and wake up this morning."

We all know the dangers of drinking and driving. I applaud these Kentucky basketball players for making the right decision. We are all glad that they were not injured in this drink driving accident. It could have caused serious injury or even death. I hope that this incident will be used to educate all Kentuckians on the serious consequences of drinking and driving.

Recall to Repair Fisher-Price Little People Builders’ Load ‘n Go Wagon

The U.S. Consumer Product Safety Commission and Health Canada, together with Fisher Price announced a voluntary recall of Little People Builders’ Load ‘n Go Wagon. About 208,000 of these products are recalled in the United States and 2,800 in Canada.

The back of the wagon’s plastic handle has molded-in reinforcement. The design adds stiffness and facilitates children gripping the handle. This handle presents a laceration hazard once children falls on it. Fisher Price and CPSC are already aware of seven reports of injuries, including five reports of children requiring surgical glue or stitches.

Involved in the recalled products are Fisher Price Little People Builders’ Load ‘n Go Wagon model number P8977. Included in the recall are a red wagon with a yellow handle, multi-colored plastic blocks and a dog figure. Wagons with green handle are not included in this recall. The products were manufactured in Mexico and sold at Mass merchandise retail stores nationwide for about $25 from June 2009 to July 2011.

If you have this kind of product in your home, immediately take the recalled wagon from your children and contact Fisher-Price for instructions on how to claim a repair kit. You may contact Fisher-Price between 9 a.m. and 6 p.m. ET Monday to Friday at (800) 432-5437 or you may visit their website at www.service.mattel.com.

The U.S. CPSC is still interested in receiving complaints or injury reports involving the product. You may tell your experience on SaferProducts.gov.

Let us all be aware of products under recall for the safety of our children.
