Kentucky One Step Closer To Texting While Driving Ban

With an 80 to 16 vote in the Kentucky House of Representatives we are one step closer to a ban on texting while driving. The Denise Harper-Angel sponsored bill rolled through the House. Let's hope this bill receives the same treatment in the Senate. Does the bill go far enough in banning texting while driving for all drivers? Will the ban on cell phone use for drivers 18 and under prevent car accidents? Is the $20 to $100 fine that is proposed as a penalaty sufficient to curb this dangerous activity? If you have been in an accident one thing you can count on is that you will be thrust into a world you are uncomfortable and mabe even confused. Unfortunately, this is what the insurance adjusters count on. You can be sure that after you have been in an accident you will be getting cals from the insurance company.

During these calls you will be asked any questions and your responses will be recorded and possibly used by the insurance company to lower the value of the claim. A simple question like "How are you today?"...most answer "I'm okay". An insurance adjuster will record that and report that just a day after the accident you said that you were okay. You may have been in pain, scared or even under the influence of pain medication.

Some may not think that it is important to find the right attorney after having been in injured in an automobile, truck or bicycle accident. True, the most important task is recovery. But do not overlook the importance of finding the right attorney for you and your specific case.

I just posted an article in my library section that goes into detail on some of the obvious thing to look for as well as the less obvious. I have compared it to finding a doctor to perform surgery on your child. It is that important. You want someone you are comfortable with and trust.

You will also consider whether you will want a person to person relationship with your attorney, some of the larger law firms will have staff members meeting with you and not the actual attorney. Other firms have the attorney meeting with you and personally returning your calls.

I have also explained why it is important to look for an attorney who will go to trial. It could mean a larger offer for settlement.

The amount of money the insurance company offers on settlements may seem arbitrary but it is usually the result of a computer program employed by the insurance company.

I have just posted an article in my news section of my website that explains how these programs work. The basic premise is that the adjuster will take the facts of the case and enter them into these programs and the program will determine a value range. The benefit is for the insurance company. By using these programs they take the emotion out of the decision making process.

Bullitt County Kentucky Woman Killed in Rollover Accident

April Abell Died at the Scene of Accident in Northern Bullitt County Kentucky-Kentucky truck accident attorney

DATE: January 16, 2010

LOCATION: Southbound I-65, near county line

TYPE: Roll-over accident kills passenger in pickup truck early Saturday morning.

Bullitt County Sheriff’s Department is investigating a fatal accident that occurred early Saturday morning in southbound I-65 near the Gene Snyder Freeway.

The accident happened when a pickup truck rolled over and the passenger was ejected from the vehicle. The passenger, identified as 42-year-old April Abell of Bullitt County, was then struck by an oncoming vehicle. She was pronounced dead at the scene.

The driver of the truck was transported by air to University Hospital for treatment of serious injuries. The investigation is ongoing.

Fender Bender Turns Fatal for Two Men in Kentucky-Louisville fatal accident attorney

DATE: January 17, 2010

LOCATION: Louisville, Kentucky

TYPE: Minor auto accident results in two injured and two others killed on Louisville roadway.

David Meredith and Omar Lopez were killed early Sunday evening when they were hit by a pickup truck on Washburn Avenue in Jefferson County Kentucky.

According to Louisville Metro Police reports the accident was the second after a minor incident. Reports indicate that a pickup truck was rear-ended by another vehicle on westbound Washburn Avenue. Four men were standing behind the pickup truck after the accident when another pickup failed to see the accident and hit the men. Tragically Mr. Meredith and Mr. Lopez were pronounced dead at the scene and two others were transported to University Hospital for treatment of their injuries.

Police report that the road conditions were foggy but do not think that the weather played a factor in the incident. Nor do they believe that drugs or alcohol were involved. Some reports say that the men standing behind the truck may have been blocking the tail lights making it difficult to see the accident.

In any situation on the road it is always safest to be the most visible. During the twilight hours is it hard to see so any measures to increase your visibility will help keep you safer. It is also important to remember that during these times of low light extra caution needs to be taken to add a degree of safety.

My condolences go out to the loved ones of Mr. Lopez and Mr. Meredith.

Pedestrian Killed in Accident Friday Evening

Pedestrian Fatally Injured in Jefferson County Kentucky- Louisville Pedestrian Accident Attorney

TYPE: Ward Chance Jr., aged 66, died after being struck by a pickup truck Friday evening.

In a tragic accident on Friday evening 66-year-old Ward Chance Jr. was killed after he was struck by a pickup truck in the 6600 block of Preston Highway. According to Louisville Metro Police reports, Mr. Chance was crossing Preston Highway and was not seen by the driver of the truck. He was apparently wearing dark clothes and not using the crosswalk at the time he was struck. Mr. Chance was transported to University Hospital where he later died as a result of multiple blunt force injuries.

Police have also reported that neither drugs nor alcohol appeared to be a factor in the accident and no charges will be filed.

It is the responsibility of both motorists and pedestrians to take measures to prevent tragedies such as this one. My sympathies go the family and loved ones of Mr. Chance.

One Vehicle Accident Kills One and Injures Three Passengers-Kentucky Fatal Accident Attorney

TYPE: New Year’s accident takes the life of Trent Nourse of Russellville, Kentucky.

An early morning accident on January first has taken the life of 23-year-old Trent Nourse in Logan County. The Logan County Sheriff’s Department has reported that the vehicle driven by Mr. Nourse left the road flipped several times before coming to rest. The accident happened shortly after 4:00 a.m. on Friday morning in the 1200 block of US 79.

Mr. Nourse, along with three occupants, were all thrown from the vehicle during the accident. Mr. Nourse was pronounced dead at the scene. Two of the passengers were transported to Logan Memorial Hospital for treatment of their injuries while the third passenger was flown to Vanderbilt Hospital for treatment of their injuries.

Kentucky Fatal Accident Kills Tamela Jones-Louisville Accident Attorney

TYPE: Two vehicle accident in Green County kills one.

Kentucky State Police are investigating an accident in Greensburg, Kentucky that took the life of 49-year-old Tamela Jones. The collision occurred Monday morning in an area south of Greensburg on Ebenezer Road.

According to reports the accident happened on a part of the road with a curve. The vehicle Ms. Jones was driving collided head on with a dump truck driven by Timothy Embry. Tragically, Ms. Jones was pronounced dead at the scene of the accident. Police have also reported that Ms. Jones was not wearing a seatbelt at the time of the accident. They also report that Mr. Embry was uninjured in the accident.

My thoughts are with the family and friends of Ms. Embry. I am saddened by another tragic loss on Kentucky roadways.

Scott County Kentucky Fatal Accident Kills One and Injures Two-Kentucky Auto Accident Attorney

TYPE: Michael Sifford Jr. was killed in a collision Saturday afternoon.

Officials in Scott County reported that one person was killed and two others were injured on Saturday afternoon after a collision on U.S. 25 in Scott County Kentucky. It has not been reported how the collision occurred.

Michael Sifford Jr., age 25, was pronounced dead at University of Kentucky Hospital after the accident that injured Glenn Rogers, age 43, and Everette Petrey, age 29. Rogers and Petrey were traveling in the truck that collided with Sifford’s vehicle and both were injured. According to officials they are both expected to make full recoveries.

Tragic Accident in Boone County with Fed-Ex Truck Kills Three.

Three Family Members Die in Accident with Fed-Ex Truck-Kentucky truck accident attorney

LOCATION:     Verona, Kentucky
TYPE:     A 45-year-old woman, her 11-year-old son and 70-year-old father were all killed in an accident involving a Fed-Ex truck in Boone County Kentucky.

Shortly before 4:00 p.m. on Tuesday afternoon an accident involving a pickup truck and Fed-Ex truck occurred on Miller Owens Road in Verona killing three people. According to the Boone County Sheriff’s Office the accident happened when 45-year-old Tamara Roberts of Warsaw was driving a pickup truck south on U.S. 42 when she lost control of the truck. As a result the truck slid into the path of an oncoming Fed-Ex truck.

The Fed-Ex truck crashed into the passenger side of Ms. Roberts’s truck killing both her 11-year-old son, Dillon Roberts, who was seated in the front seat on the passenger side as well as her father, 70-year-old Dallas Wallace, who was seated on the back passenger side seat. Both were pronounced dead at the scene and Ms. Roberts died on the way to the hospital.

The driver of the Fed-Ex truck suffered minor injuries and was treated at Saint Elizabeth Hospital in Florence, Kentucky.

Police have reported that wet and slick roads were one of the contributing factors. This is a devastating accident that will make the upcoming holiday season exceptionally difficult for the family and loved ones of the Roberts and Wallace families. My sympathies go out to them.

Double Fatality in Rowan County Kentucky Kills Johnny B. Blevins and Devin Wayne Campbell

Two Killed in Saturday Morning Accident in Rowan County Kentucky-Louisville, Kentucky fatal accident attorney

TYPE:     Fatal accident on I-64 kills Johnny B. Blevins and Devin Wayne Campbell Saturday morning.

Kentucky State Police are investigating an accident that claimed the lives of two men Saturday morning. According to their report 56-year-old Johnny B. Blevins was headed westbound on I-64 with 21-year-old Devin Wayne Campbell. They were traveling in a pickup truck and hauling a trailer with a bull in it when a tire blew out causing them to lose control.

Police reports say that as they were trying to get off to the side of the road another vehicle driven by 23-year-old Charles Ison tried to pass the pickup. The two vehicles collided and both landed upside down in the median. The police have also reported that Ison was flown to University of Kentucky hospital and his condition has not been released.

This is a perfect example of how quickly things can change on the highway. It is always smart to travel at a safe distance and a safe speed. My condolences go out to the family and loved ones of Mr. Blevins and Mr. Campbell. I also wish Mr. Ison a speedy and complete recovery.

Hit and Run Claims the Life of Joseph Estep in Hendrson County Kentucky

Hit and Run Kills Joseph Estep of Sebree, Kentucky-Kentucky accident attorney

Kentucky State Police are investigating a hit and run accident that took the life of 51-year-old Joseph Estep of Sebree, Kentucky. The collision occurred on U.S. 41 just north of Kentucky 425 in Henderson County Kentucky. According to the police Estep was riding his scooter he was rear-ended. London, Kentucky School Bus Accident Injures 10 Elementary School Children

Laurel County Kentucky Bus Crash Injures 12-Kentucky Auto Accident Attorney

LOCATION:     London, Kentucky
TYPE:     Ten students, their bus driver and the driver of the vehicle causing the accident were all injured in a crash in Laurel County Kentucky.

Thursday morning at approximately 8:30 an accident occurred on Ky. 1006 in London, Kentucky. According to the police, the SUV driven by 48-year-old Jeffery G. House crossed the center line then struck a Laurel County School bus on its front left side. Along with the driver 10 students were transported to hospitals in both London and Corbin to be treated for injuries. The driver of the SUV sustained more serious injuries and was flown to University of Kentucky Hospital for treatment. The other occupants of the bus, four students and one teacher, were transported back to Hunter Hills Elementary School.

The London Police Department has reported that the driver of the SUV was driving on a suspended license and will face criminal charges.

The driver of the bus, 31-year-old Angela Calvert, saw the vehicle coming and tried to get his attention but was unable to. She moved the bus as far over to the side as possible but was unable to avoid the crash.

The bus driver did an excellent job in attempting to avoid the crash. It could have been much worse with more serious injuries. I hope the injured have a speedy and complete recovery.

TYPE:     Driver of vehicle responsible for fatal accident on Kentucky 434 Saturday night has been charged criminally.

In a devastating accident on Saturday evening 30-year-old Thomas A. Langley died as a result. In Hardin County Kentucky at about 8:30 p.m. on Kentucky 434 there was a fatal accident. The accident happened when a truck being driven by 24-year-old Michael Brunello was heading east on the highway and struck another vehicle. The other vehicle, driven by Mr. Langley, left the roadway and overturned, ejecting him. He later died at Hardin Memorial Hospital. Police have reported that Langley was not wearing a seatbelt at the time of the accident.

Mr. Brunello fled the scene of the accident but was later apprehended. He is now facing several criminal charges; leaving the scene of an accident, operating a vehicle under the influence and having no insurance.

A crash on the Gene Snyder Freeway kills one man and injures another early this morning. The identities of the two men have not been released yet. According to the Louisville Metro Police the accident happened around 2:30 a.m. this morning.

The crash occurred in the eastbound lanes of the Gene Snyder between Beulah Church Road and Bardstown Road. The accident involved a Chevy Cobalt and a Ford Explorer. According to reports the Cobalt hit the rear end of the Explorer causing it to then lose control. The Explorer left the road, flipping several times. Both of the occupants were ejected from the vehicle. One of the men thrown was pronounced dead at the scene and the other was transported to University Hospital. Details on his condition have not been released. Police are also reporting that the driver of the Cobalt did not sustain any injuries. Police are also reporting that they do not suspect alcohol to be a factor in this incident.

This is another example of how devastating an accident can be. All accidents have the potential to cause extreme stress. My condolences go out to the family and friends of the man killed and wish the injured quick and complete recovery.

Child Burn Victim Finally Gets His Day In Court

On December 30, 2005 then 11 year old Trevor Dennis was severely burned by an allegedly defective heater manufactured by the Coleman company. Trevor's family was using the Coleman heater in their camping trailer when the heater malfunctioned destroying the trailer and severely burning Trevor. His burns require ongoing medical care. "This appears to be a case of a manufacturer using a faulty design, sub-par critical parts and inadequate quality control leading to the catastrophic injury of a then 8-year-old boy," said John Bisnar of Bisnar Chase, Trevor's attorneys.

A California Superior Court will begin hearing the case against The Coleman Company starting Monday, November 2, 2009. What is disturbing is the length of time it has taken this case to come to trial. It has been nearly four years since this accident. Trevor and his family have had to endure the pain and agony of dealing with his burns and treatment for them as well as the stress that goes along with being involved in the legal process. Coleman has not accepted responsibility for the injuries caused. I hope that the family will get the closure they need this week at trial.

Trevor will get his day in court as he stands up to the Coleman company for what he believes is right. We will keep an eye on this David v. Goliath battle and see what the outcome is of this products liability case. This is what our jury system is all about in the United States. They report that George Bradford IV was in the process of test driving a motorcycle at about 3:30 on Sunday afternoon. The accident occurred in the 12300 block of Bowman Road when Bradford reportedly lost control of the motorcycle. He then went off the road hitting three trees before coming to a stop. As a result of the accident Bradford was thrown from the motorcycle. He was then transported to University Hospital in Cincinnati by medical helicopter. Reports indicate he is suffering serious injuries. Police also report that he was not wearing a helmet at the time of the accident.

There is no law that says that in Kentucky you have to wear a helmet when riding a motorcycle but inarguably they offer protection for one of the most vital organs in your body. Any protection to the head is a good thing. We hope Mr. Bradford has a complete and speedy recovery from his injuries.

Late Saturday afternoon, shortly before 5 p.m. a car traveling northbound on Third Street Road was reported as driving erratically before it crossed over the road and hit another car head on. Louisville Metro Police Department Traffic Unit is investigating the accident.

The driver of the car traveling north was pronounced dead at the scene. She has been identified as 27-year-old Melissa Walker. The driver of the car Walker hit is reported to as being a 17-year-old. The 17-year-old was transported to Kosair Children’s Hospital for treatment of injuries suffered due to the accident. Her identity has not been released.

In a tragic accident on Friday night a couple in their eighties was both killed. The impact was so great that it sent the Robert’s into the ditch nearby.

Hundreds Die Yearly From Riding in Cargo Areas of Pickup Trucks

One of the most popular vehicles these days is a pickup truck. A friend of mine just purchased one and said it was so he could haul things. Every time anyone has to move something or needs help transporting a large appliance we go through our mental rolodex to see which of our friends has a pickup truck. They are popular in rural areas and with teenaged boys. They are great vehicles to have.

They can also be dangerous. Dangerous when passengers are allowed to ride in the cargo area. Hundreds of people die each year as a result of riding in the cargo area of pickup trucks. It should be noted that half of the victims are children or teenagers.

Four Car Accident In Bullitt County Kentucky Kills Michael L. Workman

Michael L. Workman of Taylorsville, Kentucky Dies in Collision-Kentucky Accident Attorney

TYPE:     Fatal collision in Bullitt County, Kentucky kills one and injures others.

Early Sunday morning a four car collision on U.S. 31E in Mt. Washington killed 22-year-old Michael L. Workman and seriously injured 22-year-old Kevin Sullivan. No other injuries were reported.

According to the Kentucky State Police the accident occurred when a vehicle driven by Sullivan was traveling north in the southbound lane and hit another vehicle driven by Joseph Smith. Sullivan’s car then hit Workman’s northbound car. At this point Workman’s car was then struck from behind by another northbound vehicle driven by Robert Gaddie of Radcliff, Kentucky.

Both Sullivan and Workman had to be extracted from their vehicles and were flown to University HospitalMichael.   Workman died at 2:30. Sullivan was listed in serious condition as of Sunday.

The Kentucky State Police also report that all passengers and drivers were wearing seatbelts at the time of the accident. It cannot be said often enough, seatbelts do save lives.

TYPE: The Kentucky Office of Highway Safety has issued grants to law enforcement agencies to enforce traffic laws in an attempt to lower the number of serious and fatal accidents.

The Warren County Sheriff’s Office, Logan County Sheriff’s Office, Franklin Police Department and the Russellville Police department were all awarded grants from The Kentucky Office of Highway Safety to enforce traffic laws.

With the money from the grants each of these departments will now be able to pay for more overtime hours for their officers, purchase radar detectors, breathalyzers and in-car cameras. With these additions and the presence of the officers on the roadways it is the hope that there will be safer driving resulting in fewer crashes. It could conceivably make a huge difference in several lives.

According to the Office of Highway Safety the numbers of highway fatalities have fluctuated greatly over the last 10 years. The goal is to continue to bring the number down, particularly in the rural areas where there is a high rate of fatal crashes.

These are important grants and will help keep the roads a bit safer but there is still the responsibility on the driver to keep the speed down, wear a seatbelt and be aware of their surroundings. Be safe, be aware.

TYPE:     Single car accident claims the life of Travis Popplewell and seriously injures Brently Frost.

According to reports at about 10:45 on Monday morning a Ford Focus driven by 17 year old Brently Frost lost control and hit a tree. The car was traveling on KY 76 and entered a curve in the road, it was then Mr. Frost lost control of the vehicle. The car then ran off the road and hit a tree.

Mr. Frost was airlifted to UK Medical Center for treatment of his injuries. His condition has not been reported at this time. His passenger, 17-year-old Travis Popplewell was pronounced dead at the scene of the accident. Reports also indicate that neither of the victims was wearing a seatbelt at the time of the accident.

There are few things more devastating to a family than losing a young member. Fatal Accident Kills Two in Madison County Kentucky

Double Fatal Accident in Madison County Kentucky-Kentucky Fatal Accident Attorney

TYPE: A pickup truck attempting to pass another vehicle in a no passing zone caused an accident resulting in the death of two passengers.

Kentucky State Police have reported an accident on north Kentucky 627 in Madison County Kentucky that has caused the death of Martha Collins and Martha Gipson. Ms. Collins was driving when she attempted to pass another vehicle in a no passing zone. She hit a semi truck going in the opposite direction

As a result of the crash Ms. Gipson was ejected from the car and died at the scene. Ms. Collins was trapped in the car and had to cut out. She was transported to the hospital where she later died. Ms. Collins infant son was also in the vehicle and was trapped under the dashboard. A witness held the dash off the child until help arrived and transported the infant to the hospital. The baby has been treated for a broken ankle but is expected to recover. The driver of the semi was not injured.

Our thoughts go out to the families of Ms. Collins and Ms. Gipson. We also hope for a complete recovery of those injured. We need to always remember to heed the signs prohibiting motorists from passing; they serve as a caution that passing is not safe on that part of the road.

He is believed to be in his 40’s and is also believed to be from the neighborhood around the accident scene. The investigation is ongoing and as a standard part of the investigation a toxicology test will be performed on the victim. According to the police at this point no charges have been filed against the driver.

I know I sound like a broken record but drivers need to keep their speed in check and cyclists need to do everything they can to make sure they are visible. This is the time of year when it is getting dark earlier but is still warm enough to be on a bike that can be dangerous for cyclists and pedestrians. Anyone who has traveled the stretch of I-71/I-75 in northern Kentucky knows that it is busy almost all the time. The afternoon of September 22, 2009 a motorcyclist lost his life on this stretch of highway. 60-year-old Harvey Gauthier was traveling southbound when he changed lanes and lost control of his motorcycle. He hit a wrecker that was on the side of the road which sent him back into traffic where he was hit by another vehicle. Two semis behind him were not able to avoid the accident and crashed into each other. The drivers of the semis were taken to an area hospital where they were treated for minor injuries.

It has not been reported as to whether Gauthier was wearing a helmet or not. As an attorney who has handled accident cases for almost 20 years I can tell you that on big busy roads like I-71/I-75 as a driver you need to exercise extreme caution.

Michael Blankenship from an early age had been diagnosed with autism which left him unable to speak. Due to his condition tasks we take for granted are a big deal for him. Dental work is one of those tasks. He checked into Children’s Hospital for a tooth extraction. All went well; he was discharged to his mother’s care and was prescribed a fentanyl patch to help with the pain. The patch was the highest dose of fentanyl available, usually used to relieve chronic pain in cancer patients and only to be prescribed to patients who have developed a tolerance for opium-derived painkillers.

The next morning after administering the patch Michael’s family found him unresponsive, paramedics were not able to revive him and he was pronounced dead on the scene.

As a non-medical professional I have no choice to put my trust in the hands of the medical professionals. I assume the hospital I go to hires doctors who will not make fatal errors. I assume the doctors I pay to see have my best interests in mind and will not be careless in my treatment. I assume that the pharmacists who fill my prescriptions have the knowledge to question questionable prescriptions.

This is a devastating case but the one good result that has come from this is that Michael’s mother along with the Davis Law Group have created a foundation in Michael’s name for helping autistic children and increasing public knowledge on the disease. In this day and age none of use should need a “George Bailey” to protect us and our loved ones. What we do have are lawyers like Chris Davis in Seattle that will fight for our rights.

Shortly after midnight, early Monday morning the Kentcky State Police were notified of an accident on Ky. 15 at Myrtle Little Hollow Road. According to reports the accident involve a collision between a motorcycle and a pickup truck.

Kenneth R. Pierson, 29, of Stanton was traveling north on Ky. 15 with 20-year-old Rhonda Ann Bush of Compton as a passenger n the back of his motocycle. As they were approaching the intersection of Ky. 15 and Mrytle Little Hollow Road a truck driven by 36-year-old Jason C. Patrick pulled onto Ky. 15 from Myrtle Little Hollow Road. Pierson was unable to stop and crashed into the driver's side of Patrick's truck. Both Mr. Pierson and Ms, Bush were thrown from the motorcycle as a result of the collision.

Mr. Pierson as well as Mr. Patrick suffered severe head injuries and were both pronounced dead at the scene. Ms. Bush was transported to University of Kentucky Hospital where she later died due to injuries from the crash.

Speed and Alcohol Suspected in Deadly Hopkinsville, Kentucky Crash-Kentucky Fatal Accident Attorney

During the investigation officers found a 12 pack of beer and have determined Sweeney was traveling at least 70 miles per-hour at the time of the impact with the trailer. Teen Chase Trent Killed and Brent A Wahl Injured in Crossover Accident in Henderson, KY

A teen-ager, Chase Trent, was killed and another man was seriously injured in a head-on collision between a pickup truck and a car Saturday night in Henderson, Kentucky.

Mr. Trent, 16, was pronounced dead at the scene while 56-year-old Brent A. Wahl was airlifted to St. Mary's Medical Center in Evansville. As of Sunday afternoon his condition was listed as critical.

The wreck happened shortly before 8:30 p.m. as Trent was westbound on Kentucky 351 in a 2002 Nissan. Kentucky State Police say Wahl was eastbound in a 2004 Ford pickup when his vehicle veered left of center near St. Olaf Circle and struck the Nissan head-on.

The investigation is on-going and police have yet to release why the vehicle crossed the center line. They have reported that both drivers were wearing seatbelts at the time of the accident.

Early Sunday afternoon around 1:00 p.m. two people, a man and a woman, were killed in an accident on Fern Valley Road in Jefferson County, Kentucky. According to the Louisville Metro Police the identities of the two victims are 40-year-old Toya Buckner-Dioum and 63-year-old Sherman King, Sr.

The crash occurred when a Dodge Challenger being driven by 30-year-0ld Brian Lee was traveling west on Fern Valley Road. He hit another car, a Mercury Sable, which had pulled onto the road from an apartment complex. The Challenger was from Commonwealth Dodge and was in the process of being test-driven by Lee at the time of the accident. In the car with Lee was a sales representative from the dealership as well as the driver’s brother. According to the police speed may have been a factor in this tragedy.

Mr. Lee was taken to University Hospital for treatment of his injuries. He was then taken to Metro Corrections where he has been charged with two counts of vehicular manslaughter.

According to a resident of the apartment complex there is a problem with speeding on this stretch of Fern Valley Road. It is so sad to think that two people have lost their lives because someone may have been in a hurry. My sympathies go to the families of both victims.

Unfortunately crossover accident happen with great regularity and tragically these type of accidents can cause serious injuries as well as deaths. My sympathies go to the families of those killed in this accident.

Bruce Miller of Grayson, Kentucky and William Walker Both Killed in a Motorcycle Wreck in Rowan County-Kentucky Motorcycle Accident Attorney

LOCATION:     Highway 1274 near Menifee County
TYPE:     Multi-vehicle accident kills one and injures others.

The scenic area of Rowan County Kentucky along Highway 1274 is a popular stretch of road for motorcyclists. With its winding road it also became a deadly stretch for 64-year-old Bruce Miller of Grayson, Kentucky. A car driving down the highway fell off the shoulder; in its attempt to regain control it crossed the middle line into oncoming traffic. Unfortunately, two motorcycles were in that oncoming traffic and were unable to get out of the way of the car, both motorcycles crashing into the car.

Both motorcyclists were airlifted to the hospital where Mr. Miller was pronounced dead. Days later the other motorcyclist died due to injuries from the accident. The driver and the passenger in the car were taken to the hospital for possible treatment. Sadly the story does not end here.
On the same highway another group of bikers were making their way around a tight curve when one lost control of his motorcycle and crashed into a rock wall. The rider was also airlifted to the hospital for treatment of his non-life threatening injuries.

Many people believe it is solely up to the riders to make their ride safe. Both incidents mentioned above the riders were doing the right thing. There were travelling in a group which enhances their visibility. It is up to all motorists to be aware of their surroundings, not just the motorcyclists. As the popular bumper-sticker says “Be safe-check twice”. Our sympathies go out to the Miller and Walker families and hope for a quick and complete recovery for the injured.

Kentucky State Police and the Barren County Sherriff’s office are investigating the accident that killed 21-month-old Shayla Marie Wooten on Monday evening at approximately 8:00. What witnesses are saying is that a large white vehicle travelling down the road swerved to avoid hitting the toddler but hit her.

The driver continued west and did not stop. The police are treating this as a crime investigation because the driver did not stop. They are looking for the driver of a large white vehicle, possibly a van, truck or SUV with possible damage to the right front bumper. Anyone with any information is encouraged to contact the police.

TYPE:     Fatal accident in Pulaski County Kentucky takes the life of Laura Pitman and seriously injures her husband Denzil Pitman.

According to an eye witness early in the afternoon on Thursday a 1999 Mitsubishi was traveling down Highway 196 when the driver hit a ditch, then a mailbox, flipped several times before landing upside down. Both the driver Denzil Pitman, and his wife, Laura Pitman were ejected from the car’s driver’s side. Mrs. Pitman was pronounced dead at the scene while her husband was transported to Lake Cumberland Regional Hospital then flown to University of Kentucky Medical Center.

It has been reported that this particular part of the highway is curved and police are investigating as to whether speed may be a factor. It also appears that some of the cars tires were bald and another was a much smaller replacement tire which may hamper the controllability of the vehicle.

It is as important to always important to drive in control of your vehicle, be aware of the activity around you but also to maintain your vehicle so it is safe. We wish Mr. Pitman a speedy and complete recovery and extend our sympathies to the family.

Deadly Crossover Accident Takes the Life of Demond Board-Louisville, Kentucky Wrongful Death Attorney

TYPE:     Crossover accident in Spencer County, Kentucky kills one and injures five.

Kentucky State Police are investigating a deadly accident that occurred on Friday, July 24 in Spencer County Kentucky. The accident happened on KY 55 when 34-year-old Demond Board travelling north crossed the median.

When Board crossed the median he struck a Chevy Suburban head on. Board was pronounced dead at the scene by the Spencer County coroner.

The driver of the Suburban, 46-year-old Gerry Boston, and another adult female passenger were transported to University Hospital in Louisville for treatment of their injuries. Three other passengers, all children, were transported to Kosair Children’s Hospital in Louisville for treatment of their injuries.

Crossover accidents unfortunately happen with great frequency. When driving on a road without cable barriers or anything else that could prevent the crossover be aware that another car can crossover. Be aware and prepared to avoid a potentially fatal accident.

Accident Involving Kentucky Transportation Cabinet Truck Claims Life of Another Driver-Kentucky Wrongful Death Attorney

LOCATION:     Gene Snyder Freeway, Jefferson County, Kentucky
TYPE:     Accident between Kentucky Transportation Cabinet truck and a Nissan pick-up truck claim the life of pick-up truck driver.

Thursday afternoon on the Gene Snyder Freeway in Jefferson County Kentucky near the Old Henry Road exit a Kentucky Transportation Cabinet truck was traveling approximately 10 miles per hour while it sprayed a herbicide around the cable barriers. It appeared the KYTC truck was partiallyon the shoulder and partially in the right lane at the time of the accident.

The KYTC truck was struck from behind by another truck, a black Nissan, and the driver suffered fatal injuries and died at the scene. The driver's name has not been released yet.

Witnesses are being interviewed to determine if the KYTC truck was using the flashing lights and arrow board at the time of the accident. The road was closed for over three hours. Our sympathies go to the family of the deceased.

If you are a from Kentucky and have been in an accident you can expect to hear from the insurance company on the other side. They will call you and ask for a statement or even just start asking you questions. In a news article I have just posted on my website I address this issue.

You do not have to give the insurance adjuster a statement. Many times they will call soon after the accident when you are still suffering from injuries and anxiety from the accident. It is not required that you give them a statement when they call.

Many people are very trusting and helpful by nature and will give a statement when the call comes in. You don't have to. Any information you give them at any point will be used against you. You may feel fine and tell them that only to realize a few days later that you have injuries that didn't present until then. Unfortunately there is a recorded statement saying otherwise and this could damage your accident case.

If you are a Kentuckian and have been in an accident please know that you have not just won the lottery. In other words, don't be under the impression that you will automatically get a big bag of money. This is not the case in Kentucky as well as many other states.

I recently posted an article on my website that explains what an accident victim needs to do after they have been in a car accident in reference to getting their car fixed. There are two basic routes to take in this endeavor provided the car has not been totalled.

Usually this fasest way to go is through your own insurance company. They will usually sent you to a body shop and the body shop will go from there. They will communicate with your insusrance company and you will not have to.

The procedure is similar if you go through the at-fault insurance company but there are several steps that are added to the procedure that add time and anxiety. Check with your insurance agent to determine the procedure for you and decide what will work best .

Fatal Accident in Hopkins County Claims Life of James Franklin-Kentucky Fatal Accident Attorney

WHEN: July 16, 2009

LOCATION: US 41-A, Hopkins County, Kentucky

DESCRIPTION: James Franklin, age 77, was pronounced dead at the scene of a multi-vehicle crash on Thursday afternoon.

According to the Kentucky State Police Department at around 2:00 p.m. a vehicle driven by Eric Cruce was traveling south on US 41-A. As he approached the intersection of KY 502 he prepared to make a left turn by slowing his vehicle. It has not been determined whether he had used his turn signal.

James Franklin approached from behind and failed to stop, hitting Mr. Cruce’s vehicle. After the impact Mr. Franklin’s vehicle then was sent into the northbound lane where he was hit head on by a UPS truck.

James Franklin was pronounced dead at the scene while the UPS driver, Keith Harris, and Mr. Cruce were transported to hospitals for treatment.

WE all know that accidents will happen but I often wonder if the number and severity of the accidents would lessen if drivers would watch their speed and be cognizant of the other driving situations around them. Our sympathies go to the family of Mr. Franklin.

If a person has been in an auto accident and has unfortunatley been injured they can be sure that the insurance adjuster will be trying to contact them quickly. The victim may still be in the hospital when the adjuster attempts contact. They will more than likely come across as sympathetic and looking out for your best interests. Be very careful.

It is very important for the accident victim to wait until they have finished thier medical treatment and have fully recovered before they consider settling their case. It is tempting to "take the money and run" but they need to realize that once the case has been settled it cannot be re-opened.

If an accident victim settles a case before the treatment is completed and medical complications arise they will be out of luck because the case has closed. If you have been injured in an accident it is best to be patient to insure all of your medical needs will be seen to.

DESCRIPTION: Heavy traffic on northbound 1-65 was the scene of a multi-vehicle accident injuring several and killing a young child.

In a construction zone on I-65 north in Hart County Kentucky a vehicle driven by Michael Pope attempted to avoid stopped traffic ended up striking another vehicle in the rear. The vehicle that was struck was driven by Misleni Eastman continued to hit another two vehicles.

Ms. Eastman and her 5-year-old passenger both were airlifted to hospitals in Louisville, Kentucky. Another passenger in Ms. Eastman’s vehicle, 6-year-old Jonathan Eastman, was pronounced dead at the scene. Other victims of the accident were transported to TJ Samson Hospital while one was treated at the scene. According to the Kentucky State Police the investigation is ongoing.

It is always important to pay attention while driving; this is especially true on highways where there is construction. Slow down and be prepared to stop suddenly.

This past holiday weekend was fatal for 30-year-old Lachelle Williams. Witnesses state that a vehicle being driven by 20-year-old Erick Hendrix was speeding westbound on Noel Avenue in Madisonville, KY when he lost control. The vehicle then left the road on the westbound side and continued on the sidewalk and the yard. He then struck two pedestrians, Lachelle Williams and Thomasa Wallace. Ms. Williams was pronounced dead at the scene while Ms. Wallace was transported to Regional Medical Center for treatment for her injuries. After hitting the pedestrians Hendrix continued along the sidewalk crossing a parking lot and Park Row before hitting a utility pole and a building.

Mr. Hendrix was arrested on the charges of Murder, Assault 1^st Degree, DUI 2^nd Offense (with Aggravating Circumstances), Leaving the Scene of an Accident and Possession of Open Alcoholic Beverage in Vehicle. He is currently housed in the Hopkins County Detention Center.

Fiery Crash in Clay County Kentucky Kills Two-Kentucky wrongful death attorney

DATE: June 15, 2009

LOCATION: Clay County, Kentucky

TYPE: Crossover accident involving a tanker truck filled with gasoline kills both drivers

According to Kentucky State Police on Monday afternoon a fatal crash occurred on the Hal Rogers Parkway in Clay County Kentucky. Investigators say that the accident happened when a pickup truck crossed the centerline and hit the tanker truck.

At the time of the impact both vehicles burst into flames killing the drivers of both vehicles. The intensity of the fire was so great that it took emergency crews almost an hour before they could get close. The investigators also said the victims were so badly burned that it may take days to positively identify them.

Residents near the accident site were asked to leave their homes until the police determined that the substance in the tanker was not toxic.

Saturday afternoon shortly before 5:00 p.m. an accident on U.S. 60 close to Reed, Kentucky took the life of 60-year-old Bobbie J. Major. Police report that Robert J. Williams from Wichita, Kansas was driving his vehicle at a speed that is deemed unsafe. He was traveling west when he lost control and ran off the road. He then overcorrected and veered into the eastbound lane. He then struck two other vehicles which forced them off the highway. Major was airlifted to St. Mary’s Medical Center where she died several hours later. Both of the other drivers and a passenger of one of the other vehicles were taken to Methodist Hospital in Henderson, Kentucky. Once Williams was cleared medically he was taken into custody where he is facing several charges. Police have repoted that he failed a series of field sobriety tests.

According to Kentucky State Police 59-year-old Archie Hurley was killed last night when his truck collided with another truck on Ky. 52 in Madison County, Kentucky. Hurley was traveling eastbound in his pickup truck when another pickup truck crossed the center line causing the collision.

Hurley was pronounced dead at the scene by Madison County Coroner police said. A passenger in Hurley’s truck, Patsey Hurley, 45, of Irvine, and the driver of the other truck, Keiley Harrison, 24 of Richmond, were transported to University of Kentucky Hospital by Madison County EMS. Both Patsey Hurley and Harrrison suffered facial injuries while Harrison also received injuries to her leg. The police have reported that the Hurleys were not wearing their seat belts, but Harrison was. The cause of the crossover has not yet been determined but early determinations show that alcohol may have been a factor. It is never a good idea to drive while under the influence.

Friday night in Warren County, Kentucky Kenneth Boss of Bowling Green, Kentucky died when he was traveling on Bristow Road. He left the road and went down an embankment before crashing into two trees.

The incident happened just after 5:30 Friday night on Bristow Road, near the intersection of South Goshen Church Road.

The Kentucky State Police report that another accident occurred in Campbellsburg, Kentucky on Sunday evening. State Police report that on U.S. 42 in Gallatin County the accident occurred when a driver turned in front of a vehicle driving in the opposite direction. Lonna D. Kehrer of Sanders, Ky., was killed and three other people in her vehicle suffered serious injuries. The driver of the other car, Brian J. Ritchey II of Bluff City, Tenn., had minor injuries.

Two children were injured in the accident. Kaitlyn Keith, age 9 and Savannah Stevens,age 3 were both taken to Cincinnati's Children's Hospital. None of the occupants of either vehicle were wearing seatbelts at the time of the accident.

Police now can issue a citation for not wearing seatbelts. It is a wise pratice and can save lives.

On a camping trip in December of 2005 Trevor Dennis, age 7, was severely burned. Most of the trailer was destroyed and Trevor sustained horrendous burns over much of his body that will require extensive ongoing medical care.

When the family bought the heater, it was packaged in a box showing its use in a house with a mom holding a baby on her lap with a notation expressing the heater was safe for indoor use. The statute clearly states that non-vented portable heaters cannot be sold for use indoors.

Monday evening in Lexington, Kentucky 17-year-old Nicolas Petit-Frere drove the car that crashed on Russell Cave Road. Petit-Frere should not have been behind the wheel without a licensed adult in the passenger seat, Lexington police said. One student died and three others were injured, including the driver.

Police investigating the accident feel that Petit-Frere may have been driving faster than the posted speed limit of 55, however it could be weeks before they are able to determine how fast the car was going. Police also report Petit-Frere was driving a white Toyota Camry outbound on Russell Cave between Faulkner Avenue and Interstate 75 when it swung into the inbound lane, then went back into the outbound lane, struck a rock wall and hit a tree head-on.

Nathaniel Lee Stuckey, 15, was seated in the front seat at the time of the collision died in the crash. Petit-Frere was listed in critical condition Thursday at University of Kentucky Hospital. Jasmine Marks, 16, was in serious condition, and Kierra Fultz, 17, was in fair condition. A collision report said everyone was wearing a seat belt except Marks.All four students attended Bryan Station High School.

Under Kentucky's graduated license law, permit holders must be accompanied by a licensed adult over 21. The law also prohibits permit holders from driving with more than one unrelated person under age 20 — a measure created to limit distractions for young drivers. The graduated driver's license law, passed in 2006, also requires that teens hold a permit for six months before obtaining an intermediate license. They must have a clean driving record for six months while holding the intermediate driver's license before they are issued a driver's license.

In an accident on Saturday evening at approximately 9:00 a second motorcyclist died due to injuries sustained in the accident. She then hit the guardrail and was thrown from the motorcycle. After the accident she was taken to St. Joseph of Martin where she was pronounced dead. Earlier in the day in Owen County another man was killed in a motorcycle accident. Ernest G. Sebree of Taylor Mill failed to negotiate a curve after coming down a steep hill and hit two parked cars. He was, according to the Kentucky State Police, not wearing a helmet at the time.

While he was coming down a fairly steep hill he had trouble negotiating a hill and hit two parked cars. He was transported to New Horizons Medical Center in Owenton. It was at the center where he later died. He was not wearing a helmet at the time of the accident.

The Kentucky State Police are warning drivers to be aware that since the weather is getting warmer there will be more motorcyclists on the road. They are not as visible as automobiles or trucks so check twice. I want to add to that warning and include bicyclists, runners and walkers. It is that time of the year and as drivers we need to be aware they will be on the roads.

Friday evening at approximately 9:45 pm a fatal,, accident in Nicholas County Kentucky took the lives of four people. The deceased have been identified as 53-year-old Jerome B. Hicks, 19-year-old Charles Hicks and 17-year-old Mary N. Willcut, all of Cincinnati, Ohio. Also killed in the accident was 20-year-old Robert Hughes of Carlisle, Kentucky.

According to the Kentucky State Police the accident occurred on Lake Road which is near Carlisle in Nicholas County. Hughes was traveling northbound when he attempted to pass another vehicle and hit the car traveling south. The southbound car was being driven by

Jerome Hicks had Charles Hicks and Mary Willcut as his passengers. Ms Willcut was seven months pregnant at the time of the accident. All were pronounced dead at the scene as was Hughes.

The passenger in Hughes' car, 20-year-old Dylan Boone also of Carlisle, was transported to University of Kentucky Medical Center and has reported to be in stable condition. The case is currently under investigation by the Kentucky State Police.

To help prevent these types of accidents it is important when passing another vehicle make sure it is in a passing zone on the road, the intermittent yellow lines as opposed to a solid yellow line. If it is solid, don't try. There could be hills and curves that prevent accurate visibility of oncoming traffic. Also, if someone is passing you, please slow down and allow them to do so safely.

According to Kentucky State Police at around 9:20 a.m. on Wednesday morning a Waste Management dump truck was traveling north on I-65 near Lebanon Junction in Bullitt County Kentucky. The driver of the dump, Steven Barnes of Lebanon Junction, lost control of the truck which crossed the median. Paul Waddle of Louisville, Kentucky was parked in the right shoulder of southbound I-65 when the truck crossed the median, striking his car. The impact of the accident caused the death of Mr. Waddle. Kentucky State Police have reported that he was pronounced dead at the scene. The driver of the truck, Mr. Barnes, was taken to University Hospital for treatment of minor injuries.

It is not known why Mr. Barnes lost control of the truck and the police have indicated that no charges will be filed against him.

Several sections of I-65 and other interstates around the state have had cable barriers installed to prevent crossover accidents. I have noticed numerous times while driving on the interstates that have them installed sections that have been bent and car wreck debris and my immediate thought is how that barrier kept a vehicle from crossing over and causing a more devastating potential fatal accident. I hope that soon all interstates will have these barriers installed.

Even though Kentucky’s seatbelt usage has increased from 72 percent in 2007 to 73 in 2008 we as a state are still well below the national average of 83 percent. According to the Kentucky Transportation Cabinet the increase is due to the passage of the primary seatbelt law in 2006. This law will allow officers to issue citations solely for people not wearing their seatbelts. Before this law, officers were only allowed to issue citations to people who were not buckled up if they were pulled over for other offenses. Officers did not have the authority to pull someone over if the only offense was that they were not buckled in. Since the 2006 law an officer can issue a citation for not using a seatbelt even if there is no other offense. As part of the camapign officers will be monitoring roads for drivers and passengers that are not wearing their seatbelts.

Since the passage of this law the Kentucky Transportation Cabinet has also noted that the number of traffic fatalities has gone down. In 2005 there were 985 traffic fatalities, in 2007 the number went down to 864 and even though the Kentucky State Police are still compiling numbers for 2008 their records show that there were 842 traffic fatalities last year.

One of the largest contested issues going today is the use of cell phones while driving. In January the National Safety Council launched a major awareness campaign around the issue. Some feel that it should not be allowed, other feel that only hand held devices should be banned, others feel that there should be no text messaging. On the other hand there are those who feel that there are other actions that drivers take that are as distracting if not more, eating, adjusting or even just conversations with another passenger in the vehicle.

A deliveryman for UPS had become so frustrated with drivers talking on the phone that he is developing what he hopes to be a solution that will save lives. Fred Wenz teamed up with a friend, John Fischer, and together they developed a security device that would block the incoming and outgoing radio signal to and from cell phones for a 5-foot radius around the drivers seat. It's modeled after ignition locks that can't be activated until a convicted drunken driver passes a blood alcohol check by blowing into a monitor on the dashboard.

Wenz and Fischer have applied for a provisional patent on the device. The device is called an “Owner Compliance Key” and the two are actively looking for funding for the device.

Nationally, more than 2,600 people die and another 12,000 are seriously injured due to the phenomenon, according an estimate prepared by the Harvard Center of Risk Analysis and reported by the safety council. There are other studies indicate that a driver talking on a cell, even on a hands-free device such as a Bluetooth headset, is four times more likely to get into a crash - and those rates raise exponentially when texting.

•    If you stop at a restaurant, bar or café and set your bag down, put your foot through the strap. That way it won't be taken without you knowing. Also, you'll remember to take it with you when you trip over it as you leave.

Everyone has heard of the horrific skiing accident that has taken the life of 45-year-old actress Natasha Richardson. In what seemed to be a minor fall on a ski hill in Canada she suffered an unusual brain injury that cost her her life.

After her fall she appeared to be fine. Lucid and even light-hearted about her accident. It wasn’t until a few hours later her health began to fail. She was transported to a hospital in Canada then was transferred to a hospital in New York. On Wednesday she died due to a epidural hematoma due to blunt impact to the head. An epidural hematoma is defined as a type of intracranial hematoma (blood clot or clots) that often results from a skull fracture.

Epidural hematoma should be suspected in any individual who sustains head trauma. Symptoms include:

    * Seizures

A new trial has been requested by the owner of Stoam Holding due to information that has surfaced pertaining to one of the jurors. I have told both of my teenaged daughters to be very careful about what they post on their social networking sites (Twitter, Facebook, Myspace, etc) The information they are publishing could be seen by people it is not intended for. In an accident that occurred over a week ago in Hardin County, Kentucky a 17-year-old victim is still in critical condition fighting for her life. Jennifer sustained several injuries. A broken femur, a broken and dislocated hip as well as head trauma. She is lucky to have the love, support and prayers of her family and friends.

At the time of the accident Jennifer did not have any identification on her so she was admitted to the hospital as a Jane Doe. Her identity was not discovered for several hours at which point her mother was notified. It is scary for all of us to think about a loved one facing a trauma like that alone. It is important to always have identification on us for just such emergencies. My family all have cell phones and each of us have programmed an ICE number. ICE stands for “In Case of Emergency”. That is so the necessary people can be notified in such emergencies. Our thoughts go out to Jennifer and her family.

In an accident late Monday night near the intersection of Terry Road and Venango Drive a motorcyclist was killed in an accident. He was pronounced dead at the scene. Police have reported that the victim was wearing a helmet at the time of the accident.

Kentucky Transportation Cabinet is Asking Motorist to be More Cautious During Debris Removal

Earlier this week a multi-vehicle accident occurred on KY 176 in Muhlenberg County. Five vehicles were stopped at a work zone when another vehicle hit the last car. This caused a chain reaction, damaging numerous vehicles.

The work crew was working on debris removal when the accident happened. The crews usually work from morning to night and are required to post signs indicating work areas. The Kentucky Transportation Cabinet has asked drivers to be alert and pay close attention to the signs. It is estimated that the debris removal will continue for several more months.

Car Accident Victims Suffering From Post Traumatic Stress Disorder

Last week I posted an article on my website about post traumatic stress disorder and car accident victims. In this article there are listed causes and symptoms of PTSD. It came as no surprise to me when I was doing my research that in the general public car accidents are the leading cause of PTSD. PTSD is an anxiety disorder that can develop after a person is exposed to a traumatic event. During these events something horrible and frightening is happening and the person has a sense of helplessness. They may also feel like their life or the lives of others are in danger. If anyone has ever been in a car accident you know that is exactly what you experience.

My daughter and wife both have had a few car accidents in the past few years. Fortunately neither was hurt but both get nervous when they are in the car and another car gets too close or if they think another car is about to crash. Crossing Guard Struck and Killed in Front of Middle School in Louisville, Kentucky

At about seven this morning a crossing guard was struck and killed in the Jeffersontown area east of Louisville. The accident happened in front of Carrithers Middle School which is located on Billtown Road in Jeffersontown. Apparently a truck traveling east on Billtown Road struck the crossing guard causing her death. The speed limit is 35 miles per hour but it is not known if the flashing lights that indicate a school crossing had been turned on at the time of the accident.

As I have said many many times when you get behind the wheel of a car it is your responsibility to be aware of your surroundings. Know what the speed limit is and obey it. If you are in a high pedestrian traffic area please slow down. If you are driving near a school be extra cautious, there may children around that might not see you. Slow down and be aware.

Fatal Accident in Green County Kentucky Results in Criminal Charges

As a result of a two vehicle accident that occurred February 12th 51-year-old Russell A Greenway was killed. The accident happened on US 68 just east of Greensburg when a truck being driven by John P. Greene and traveling east crossed the center line. The truck hit a Toyota being driven by Sheila Marinez, Greenway was a passenger in her car and was pronounced dead at the scene.

Ms. Martinez was taken to the Jane Todd Crawford Hospital where she was treated than released. Greene, the driver of the truck was flown to University Hospital where he too was treated then released. Greene was arrested on Friday and charged with several crimes. One count of manslaughter second degree; one count of operating a motor vehicle under the influence of alcohol/drugs, aggravated circumstances, second offense; reckless driving; and failure to give oncoming vehicle half of highway.

Getting behind the wheel is a huge and far reaching responsibility. If you are not in a condition to drive the simple answer is don’t do it. Acts of irresponsibility can cost people their lives.

Lowering the Cost of Car Accidents by Keeping Car insurance Costs Down

I just added a news article to my website reporting a fear by many that with the decline in the economy people will either lower their car insurance coverage or even drop it. This trend could cause some very expensive accidents. The Property Casuality Insurers Association of America has offered some solutions but I have some ideas based on my years of experience in handling accident cases and dealing with insurance companies.

I do not believe an uninsured driver should be penalized for not maintaining insurance if the accident wasn’t their fault. They are injured through no fault of their own and the injury could be catastrophic. I believe this is an attempt by the insurance industry to decrease the number of legitimate claims that they will have to pay as more and more divers are on the road without adequate coverage, The at-fault responsible party should have to pay regardless of the insurance. This type of status disqualification would be a very dangerous precedent to set and a windfall for the already fat insurance industry. Under Kentucky law the state court of appeals has already stated that an uninsured motorist can not collect from the at-fault driver his first $10,000.00 in medical bills. He has to pay this first $10,000.00 no matter what. Although I don’t agree with this law, I believe this is more than enough penalty for an uninsured motorist that is in an automobile accident through no fault of their own.

Based on my experience I do not believe that increasing the penalties for driving without insurance will have any affect on lowering the number of drivers on the road without insurance. The penalties in Kentucky are:

•    A fine from a minimum of five hundred dollars ($500.00) up to a maximum of one thousand dollars ($1,000.00) and /or up to 90 days in jail.
•    Have the registration of the motor vehicle revoked and the license plates of the vehicle suspended for one (1) year or until such time as proof of insurance on the vehicle is obtained.

An increase in these jail sentences and fines would not make the majority of people purchase insurance. One does not think of the consequences when deciding between car insurance and bread on the table. Enforcement of the current laws would have some affect. I believe a better plan would be to put the burden on the insurance industry. If the insurance company would notify the State if insurance was not paid so that the state could send a letter stating that the person’s driving privileges would be suspended unless valid proof of insurance is provide with 7 days, I believe our numbers of uninsured drivers would decrease.

Crash in Guthrie, Kentucky Kills Two

In Todd County Kentucky on Wednesday morning a crash took the lives of 72-year-old George Tolliver and 2-year-old Adam Grant. Tolliver was from Todd County and Grant was from Springfield, Tennessee.

At 10:00 a.m. on Wednesday morning at the intersection of Highway 41A and 181 near the Kentucky-Tennessee state line a Jeep crossed the center line. State troopers believe the strong wind may have may have been a factor in the vehicle crossing the center line. The Jeep hit Tolliver’s white truck head on. A van traveling behind the truck did not have time to stop and crashed into the truck. None of the van’s occupants were injured.

The weather in the area has been so unsettled recently that it is very important as a driver to be aware of the conditions. There are precautions you should take when driving in high winds as well as in rain and snow. Taking precautions may help prevent accidents on the roads.

Pedestrian Hit While Crossing the Street in Shelbyville, Kentucky

A friend of mine from church was hit as she was crossing the street in Shelbyville, Kentucky last week. In a phone conversation with my wife this morning she said (with a little sarcasm) “I should have known that the truck driver didn’t see me and my bright red coat as I was crossing the street in the cross walk. I was also waving to him. This is what we do in our small town, we wave at people.”

Fortunately our friend’s injuries were not catastrophic. Her arm was broken to the degree she had to have surgery and have a plate put in. The driver of the truck feels horrible, came to the hospital to check on her and feels true remorse. My friend will more than likely recover with no issues but that path of recovery will probably be a painful one for her.

As I have said numerous times acute awareness is one of the major keys in preventing accidents. Awareness on behalf of drivers, bikers and pedestrians alike. Never make the assumption that you are seen by the other people on the road. Unfortunately, pedestrians must learn first and foremost not to trust the driver of any vehicle. Just because you see a stop sign doesn’t mean the car will see it and stop. Just because the walk sign starts flashing “walk” doesn’t mean you should walk blindly into the road. Make sure that the cars have stopped. Driver inattention can be deadly to the pedestrian.

After the recent storms in the Louisville, KY area I thought it beneficial to offer information on hydroplaning. I added a news article to my site that offers strategies drivers can use to prevent hydroplaning.

Hydroplaning happens when a person is driving on wet roads and their tires lose contact with the road causing them to lose traction and control of their vehicle. In the article I added to the website some of the strategies I offered were to have tires with good traction and appropriate pressure, drive slower in wet conditions and avoid slamming on your brakes. There are several more.

As with all of the other driving tips I have offered, driving in high wind and driving in snow and ice the common theme is to slow down and be aware of the conditions before you. There is an old saying that goes something like”An ounce of prevention is worth a pound of cure”. Senior Citizens are Safer on the Road

We have all complained about old people on the roads. It seems that anytime we are in a hurry there will inevitably be a senior citizen on the road in front of us. Instead of complaining about their slow driving be thankful they are slowing down and being more cautious.

I just added a news article to my website with some truly enlightening information. It seems that older citizens are statistically safer behind the wheel than they used to be. There are several reasons for the decline in the number of injuries and deaths associated with senior citizens and auto accidents.

•    They are limiting their driving to safer conditions and circumstances.

Accident Prevention Tips For Driving in High Winds

The last six months in Kentucky have been interesting to say the least. Two different storms have debilitated several communities around the state. The wind storm in September caused thousands to be without power for several day, some over a week. We all licked our wounds from that event vowing to get a generator. I made that vow, haven’t followed through though. Two weeks ago the state was slammed with an ice storm that again knocked power out for many across the state. Again it took over a week to restore power in some areas.

We all have the ego that says “This can’t happen again, we have paid our dues.” Weather patterns don’t have memories, they don’t think “We have hit Kentucky twice in the past six months. Let’s move onto Pennsylvania.”   Looking at the weather forecast this morning it reports that we are in store for high winds the next few days. This can be dangerous. There are probably still limbs and branches hanging in trees from the ice storm that with a good gust of wind could knock them out. Be very careful.

Incredible Young Man Dies in Auto Accident

One month ago the world lost a very special young man in a horrible car crash. Connor Larimore, aged 11, was in the car with his father and younger brother going to church. Traveling down Highway 22 a collision occurred with another car. Connor , as well as his father and brother, suffered serious injuries. They were all transported to the hospital where Connor died two days later. His brother suffered broken bones while his father suffered many broken bones in both legs as well as back injuries. Mr. Larimore’s recovery and rehabilitation may take several years.

This particular accident has had a personal effect on my family. Connor was a former student of my wife’s and spent time with my daughter playing computer games. What they have both said about Connor is what a kind-hearted person he was. He always had a smile to give. His work ethic was very strong and was always appreciative of everyone. The world is a little darker because this polite and brilliant young man is gone.

Alabama Is Jumping On the Cell Phone Band Wagon

There are currently several states that ban the use of hand-held cell phones while driving. Kentucky is not one of them, yet. There is a bill before the Kentucky Legislature that would ban the use of handheld phones while driving. I am personally all for the ban.

In Alabama the House Public Safety Committee approved a bill that would fine drivers for text messaging while driving. This includes writing, sending and reading messages while driving. The fines would be $25 for a first violation, $50 for the second and $75 for each violation after that. The committee did however kill the bill that would disallow the use of hand-held cell phones. The bill now goes to the Alabama House where it will come to a vote.

I am for the bill that would ban the act of text messaging while driving. I am also for banning the use of hand-held cell phones while driving. I am also against any act that would put the driver at risk of causing an accident. This includes putting on make-up, reading the paper and writing. The list of distractions goes on. Louisville Cyclists Can Now Track Dangerous Areas Thanks to BikeClicks.com

Safe Rides is a program in Louisville recently launched by BikeClicks.com., Louisville’s online community for cyclists. This tool was developed for the use of cyclists to help them be aware of trouble areas before they take their next ride. Bikers can log dangerous areas, incidents and conditions on local roads into a database for other cyclists to see. This tool is a combination of Google Maps, Street View and a BikeClicks database.

As a rider I have experienced my fair share of being chased by dogs, buzzing and yelling from mad drivers and other unsafe incidents on the road. Usually the only way I can pass the information to my other cycling buddies is by word of mouth. Not reaching everyone who might want the tips. With this new program I can log on, pass on the information, see the trouble areas and adjust my route accordingly. I am thrilled with this program and my hat is off to BikeClicks.com.

How to Prevent Snow Related Accidents

As I was driving my daughter to school this morning the snow started coming down again. At first I was mesmerized by star wars like view I was getting. Then a car went flying by me. Now I know that the roads can’t be as bad as they were during the ice storm, but I thought “This idiot is going to cause an accident”.

Last week I was in Colorado skiing. As I drove up I-70 toward Loveland Pass it was dumping snow. Over a foot was in the forecast. As I crept along I was getting passed frequently. Approaching the Eisenhower Tunnel there were cars off the road everywhere. Why? I started to wonder. Colorado gets so much snow that everyone knows how to drive in it. The way they remove snow and keep the roads clear amazes me. Then it dawned on me. Everyone is in a hurry.

SLOW DOWN. That was what I was thinking. If everyone slows down 75% of the accidents may not occur. Please be careful when driving on snow and icy roads . If you slow down, leave a little earlier and use some common sense I am hopeful that you can avoid an auto accident. Will a Cell Phone Law Prevent Accidents in Kentucky?

This is the question of the day. The National Safety Council is saying that it will while the cell phone industry maintains that education will offer better prevention than legislation. The Kentucky legislature has two bills pending that would ban the use of hand-held devices while driving and ban the use of any communication device by anyone under the age of 18 while driving.

The two sides of the coin are the NSC maintains that talking on the phone while driving promotes a dangerous level of distraction and is the cause of many accidents. The other side is the cell phone industry maintains that there are many activities that are potential driving distractions. Eating, adjusting various controls in the car, reaching for objects and other passengers can take a persons attention away from the task of driving. According to the cell phone industry educating the public on safe cell phone usage would be more beneficial.

I have had many clients who were victims of auto accidents where the person responsible was on the phone and not paying attention. Their injuries and the nightmare of having to deal with all that is involved with being in an accident could have been prevented if the person causing the accident had not had their phone up to their ear. Not only should these laws be passed but the penalties should be more severe. Potential jail time could go pretty far in saving a life. Cadiz Man Dies in a Fatal Accident

After a collision on January 4th a man from Cadiz, Kentucky was killed. The collision occurred on Ky 274 at a point where the road curved. George Dunn, aged 57, was traveling north when he and Codie Atwell, aged 19, collided near the middle of the road. As a result of this accident Dunn suffered injuries that took his life.

Both vehicles were damaged so severely that rescue workers had to rely on two sets of the Jaws of Life to remove the occupants. Usually the Jaws of Life just take a matter of a few minutes to extricate people from vehicles but that was not the case here. Not only did the rescue workers have trouble starting the rescue truck they also had to wait for gasoline for one of the sets of the Jaws of Life. It is unknown to me if the equipment failure was the equipment used to rescue Dunn or Atwell.

Ignition Interlock Systems in Place to Prevent Drunk Driving Accidents

In an effort to reduce drunk driving six states, Alaska, Colorado, Illinois, Nebraska, Washington and South Carolina, will start the year by requiring persons who have been convicted of drunk driving to install ignition interlock systems. These systems, once installed, will prevent a car from starting until the drivers blow into the alcohol detectors to prove they are sober.

There are many states that have ignition interlocks available as a possible penalty for repeat DUI offenders but starting this week Alaska, Colorado, Illinois, Nebraska and Washington will require the device for all first time drunk driving convictions. South Carolina began requiring them for repeat offenders the last week of December

The cost for the device is approximately $80 to install, $80 per month to rent and a $30 per month state fee. One of the flaws in this system is that the driver could have someone else blow into the system but if they are caught trying to circumvent they could go to jail.

One of the harshest critics of this program is the American beverage institute. They agree with the program for repeat offenders and persons arrested with very high blood alcohol levels but fear that this program will create a country where people will no longer be able to have a beer at a ball game or a glass of wine with dinner. Concern should also be on excessive speed and distracted drivers for causes of deadly accidents.

The bottom line is if you are impaired in any way you should not drive. If you have to perform a task that will take your attention away from driving you need to pull over. Don't Be An Idiot When Riding A Bicycle

I was driving to work earlier this week on a morning when the weather was sleeting, freezing rain and a snow combination. It was 7:30 AM and I had just dropped my daughter off at her high school. I was headed down Bardstown Road, which is one of the busiest and most dangerous roads in Louisville. I know that there will be idiots on the road in this type of weather but I was astonished to see someone on a bicycle in such nasty weather. Unfortunately he was riding his bike like an idiot. I commend anyone that commutes on a bicycle, especially in such cold and nasty weather. Although I do wonder about the safety of riding on icy streets, not only for the bikes’ ability to turn and stop, but for a driver of a car to be able to react to the bike.

This being said, what really irritated me was that this biker was weaving in and out of traffic. I don’t think he realized it, but he almost got hit by another car in the short time I was following him. As most of you know I am an avid recreational bicyclist. Anytime someone is reckless in the way they ride a bike it makes it harder for me when I am on the roads. Both bikers and cars must respect each other on the road. If you are riding a bike in this weather please be smart about it. Thankfully this person was wearing a helmet even though he was not using his head in the manner he was riding. I hope he made to where he was going. Please be smart and use your head during the holiday season and avoid being in n injury accident, whether it is with a car or a bicycle.

Fatal Accident in Meade County, EMS Nightmare

Early Thursday morning on a rural road in Meade County Kentucky 18-year-old Chelsea Stinnett was on her way to pick up a friend for school when she was involved in an accident which took her life. Meade County sent an available EMS crew to the scene, a member of the crew was Chelsea’s mother, who now is living out what every emergency worker fears and dreads.

Due the tight knit nature and family atmosphere of emergency workers once the EMS departments in surrounding counties heard of the accident they sent their own crews to help in any way they could. Emergency workers can work shifts of 24 hours which allows their families to know and become part of the whole “emergency community”. Everyone gets to know the spouses and children of the other workers. All Meade County EMS workers are grieving the loss of Chelsea and doing what they can to support her mother during this terrible time. My heart goes out to all who are grieving this loss.

Fatigued Driver to Blame for Fatal Accident on Kentucky Highway

Thursday afternoon a woman was killed, and others suffered injuries due to a crossover accident on U.S. 60 near the Jefferson/ Shelby County line. The accident occurred when the driver of a westbound car may have fallen asleep while driving, crossing over into the eastbound lane striking another car. The passenger in the eastbound car was pronounced dead at the scene, the driver of the eastbound car suffered two broken legs. The driver of the westbound car along with his passengers, two children were transported to the hospital with non-life-threatening injuries.

Driver fatigue is an issue that people may not realize it is effecting you when you don’t know it. You can ask many new parents who have babies that have trouble going to sleep how they remedy the problem. One of the most popular and successful tricks is riding them around in the car. They generally fall asleep pretty quickly. Cars are geared for comfort, climate control, heated and cooled seats and comfortable seats. Add this to the humming the cars make and any driver may become sleepy at the wheel. There are several ways to prevent driver fatigue, a few are listed below:

•    Stop driving if you feel sleepy. Drink a caffeinated beverage but wait 30 minutes or so before taking the wheel again. That’s how long it takes for the caffeine to enter the bloodstream.. You may use that 30 minutes to take a short nap.
•    Drive at times when you are normally awake.
•    Avoid foods that are high in carbohydrates, they can make a person sleepy. Opt for foods with high protein levels.

Deadly Crash on Icy I-71

The Kentucky State Police reported Saturday morning that the roads were icy and dangerous. Interstate 71 in Gallatin County was indeed icy, the conditions caused 43-year old Charles Wohlfrom to lose control of his truck. He crossed the median into oncoming traffic where he hit another vehicle head on. The other driver, Deborah Corum, was uninjured but Wohlfrom died as a result of his injuries. The Kentucky State Police also report that both Wohlfrom and Corum were wearing their seatbelts at the time of the collision.

The condition of the roads came as no surprise to anyone. With the state of the art weather prediction devices available we can know with a strong degree of certainty what the weather holds for us. It is very rare that dangerous weather hits without some degree of warning. Having said that I am not sure what measures were taken to treat the roads to make them safer. Anymore whenever there is a mention of slick weather you can see the tell tale signs of brine having been put down. I have also seen salt trucks parked on the side of highways ready to go when snow is predicted. Proper treatment of the roads along with safe driving skills can make snowy roads a bit safer

It is impossible to say whether this accident would have occurred but with the number of other accidents that happened in the same area at about the same time frame it tells me that the roads may not have been treated properly. My thoughts go to the victims family duing this holiday season.

Shelbyville Accident Kills One and Injures Another

In Shelbyville, Kentucky on Friday night a man lost his life in an automobile accident. The accident occurred on La Grange Road when a car being driven by Roy Mullins of Monroe, Ohio crossed the center line striking another car head on. The driver of the other car, Thomas A. Alvarado of La Grange, Kentucky, died as a result of the accident.

There are many reasons that a car will cross the center line of the road. Most all of them are preventable. Unfamiliarity of the road can be remedied by driving slower. Speeding, again drive slower. Tips For Driving Safely in Snow and Ice

As a kid there is nothing better than a snow day. It is truly a gift. To wake up only to find out that there is no school is great but add to it a winter wonderland outside your door is humbly put...fabulous. For adults snow days create more of a problem. As adults we generally don’t get snow days and on these days of winter beauty we have to go out on slick roads and navigate our way to work or other obligations we may have. There are a few safety tips that can make you trek in the snow a little safer.

•    Check your tire treads.   A tire needs at least 6/32 inch deep tread for good snow traction. Summer tires have no traction in the snow and not all all-season tires have good snow traction. Check your tires to make sure.

•    Ramp up your windshield. Replace your wipers and thoroughly clean the inside of your windshield. Also make sure your wiper fluid has a de-icing agent. Run your air conditioner to prevent condensation on the interior of your windshield. Good visibility is a must for safe driving.

•    Double check your headlights and taillights. Make sure they are working and not covered with snow when you hit the road.

•    Be aware of black ice. It is a sheet of ice that looks like a puddle but is actually a sheet of ice. If you come upon what looks like a puddle double check by slowly checking the traction.

•    Be aware of areas that you know are problems. Avoid them if possible and if unavoidable proceed with caution.

•    Don’t steer too much when you hit a patch of ice. If you do when you leave the patch your car will head in the direction of where you are steering.

•    Make sure you don’t go onto the roads with a false sense of security. Know that even if you have 4-wheel drive, anti-lock brake system and electronic stability control you are still at the mercy of the elements and should exercise extreme caution.

Pedestrian Killed Early Sunday Morning

Early Sunday morning on Bardstown Road in the Fern Creek area 47-year-old James Deramus was struck and killed. He was attempting to cross the road when he was hit by a SUV traveling in the southbound lane. The force of the impact sent him into the northbound lane where he was struck a again, the second time by a truck. Demarus was transported to University Hospital where he died.

At the time of the accident it was raining and had been for sometime so the roads were damp and most likely slick. Demarus was also wearing dark clothes making it difficult for him to be seen in the early hours. According to the police charges will most likely not be filed against either of the drivers.

This is the time of year to be especially alert as both a driver and a pedestrian. Shorter days and weather can make it more difficult for pedestrians to be seen. With that in mind drivers need to be more alert and pedestrians need to exercise added caution when crossing busy streets to prevent injuries and fatalities.

One Car Crash on Gene Snyder Kills One, Injures Others

Late Tuesday night, November 25th, on the Gene Snyder Freeway, close to the Preston Highway exit, a one car crash claimed the life of one and injured three other passengers in the car. At approximately 11:45 p.m. a Chevrolet heading westbound lost control and left the road. It seems that speed was a factor in the crash but alcohol was not.

The driver as well as all of the passengers were taken to the hospital where 34-year-old Ernesto Martinez-Romirez was pronounced dead. The other injuries were not life threatening. Romirez was a passenger in the back seat and was not wearing a seatbelt at the time of the accident.

This particular stretch of the Gene Snyder has cable barriers in place and according to police when the car lost control it struck the barrier preventing a crossover accident. There have been several fatal accidents this year involving cars crossing over the median into oncoming traffic so in certain areas cable barriers have been put up in an effort to prevent potentially horrible accidents.

How Safe are Smart Cars?

Anyone who has a teenage girl has undoubtedly heard “Isn’t that cute?” whenever they see a Smart Car. The Smart Car is classified as a micro car and is the smallest car sold in the United States. The vehicle weighs only 1,800 pounds and is 8'8". When looking at this car one of the first thoughts is about it’s safety should it be involved in a car accident.

In a report released by the Insurance Institute for Highway Safety the Smart Car offers a “good” level of safety in front-end and side-impact crashes. “Good” being the highest rating in testing scores. In rear crashes it scored the second highest score of “acceptable”. The tests administered were of speeds in the 30-40 miles per hour range making the Smart Car better suited for urban driving where high speed crashes are less frequent. It should also be noted that even though this car received “good” ratings a larger, heavier car with lower ratings may still be safer. Bigger and heavier is always safer. The popularity of these vehicles is widespread, the Smart division of Daimler has received over 30,000 requests for this particular two-seater. Louisville Metro Police Efforts to Decrease Car Accidents

Paramedic Arrested for Fatal Hit and Run

On Highway 54 a 33-year-old man, Antone Wilkins was struck and killed as he walked down the highway. The accident happened just north of Fordsville, Ky. The driver did not stop after the accident.

Kentucky State Police have arrested 29-year-old Brian Bellamy in connection with a fatal hit and run last week. He has been charged with murder and leaving the scene of the accident. Bellamy, who is a paramedic, is in the Ohio County Jail on $100,000.00 bond.

Kentucky State Police have indicated that they have a "sizeable amount of evidence linking Bellamy to the crash". The detectives investigating the accident have reported that they don’t think race was an issue in the accident but alcohol may have been.

Leaving the scene of an accident is a criminal offense in and of itself. This is the case no matter how minor or insignificant the damage or the injury is . One should always stop if they have been in an accident, especially in catastrophic accidents such as this one.

A question always comes to mind as to why someone leaves the scene of an accident. In this case it is obvious due to the horrible result. In other cases the hit and run driver may have an outstanding criminal warrant or may not have car insurance. Trimble County Man Arrested in Fatal Accident

In an accident on U.S. 421 Jose Luis Benitez of Milton, Ky was killed and three other were injured. The accident occurred when Herberto Rodriguez was driving northbound on U.S. and attempted a left turn into a parking lot. A 2000 GMC pickup was traveling southbound on the same road and was not able to avoid striking Rodriguez’s car on the passenger side.

Benitez was in the passenger side of the back seat at the time of the collision and was pronounced dead at the scene. The other passengers in Rodriguez’s car, Julio Hernandez, age 34, and Sixto Hernandez, age 20 sustained minor injuries. The driver of the pickup truck, Lori Howdyshell of Milton, also received minor injuries.

Rodriguez was treated for minor injuries at Carroll County Memorial Hospital then transported to the Carroll County Regional Detention Center where he was charged with driving under the influence as well as manslaughter. Kentucky State Police reported that none of the victims in Rodriguez’s were wearing seatbelts at the time of the accident. The investigation is ongoing.

Another Pedestrian Fatality on Jefferson County Roads

Thursday evening around 6:45 on Dixie Highway 58-year-old Clara Watts was struck while attempting to cross the road. This occurred near the intersection of Dixie and Lewiston Place. After being struck Ms. Watts was transported to University Hospital where she died not long after she arrived.

The investigation shows that a Ford was traveling northbound on Dixie Highway when Ms. Watts stepped into the car’s path. The investigation also reports that Ms. Watts was wearing dark clothes at the time of the accident. Louisville Metro Police Department Traffic Unit has reported that no charges are expected to be filed against the driver of the Ford.

This is a dangerous time of the year for pedestrians as it is getting darker earlier. Particularly during rush hour when drivers may be more distracted pedestrians need exercise more caution.

Four Dead in South Central Kentucky Auto Accident

On October 14th in Clinton County Ky. An accident immediately claimed the lives of three, almost two weeks later a fourth victim died at University of Kentucky Hospital.

The accident occurred on US 127 approximately two miles south of Albany, Ky. Shortly before 8 p.m. on south US 127 a vehicle being driven by 29-year-old Candi Byers lost control. The car slid into the northbound lane and struck a 2004 Ford Ranger Pickup. In the car with Byers was another passenger, 3-year-old Kasen Byers. Both were pronounced dead at the scene. The passenger in the pickup, 48-year-old Belinda Logan, was also pronounced dead at the scene. The driver of the pickup, 44-year-old Brenda Logan, suffered serious injuries and was flown to University Hospital in Lexington, Ky. Brenda Logan died on October 26th at University of Kentucky Hospital.

This fatal accident was investigated by the Kentucky State Police. It has been reported that none of the adult victims were wearing seatbelts and the child was not in a car seat at the time of the accident. Automobile accidents happen daily and unfortunately people die because of these accidents. Wearing seatbelts and restraining your children is a law in Kentucky. It is impossible to speculate as to whether wearing seatbelts could have prevented the deaths of the victims in this crash. Felony DUI Charges Reduced

Local insurance agency owner Robert Clarkson was driving while under the influence of alcohol in June of this year. While driving under the influence he hit a motorcyclist causing several injuries. Clarkson was facing felony assault charges as well as DUI charges. During the prosecution process the prosecutors offered to amend the felony charge to a misdemeanor charge of careless driving.

The victim in this particular case had no objection to the plea agreement. A felony conviction would have impacted Clarkson’s insurance policy which was a multimillion dollar policy. Despite this, the Jefferson County Attorney made a motion to set aside the plea agreement and to allow the case to proceed to trial. The Jefferson District Court Judge denied the motion and let the plea deal stand.

Plea deals have received a bad rap over the years. Many of us have the picture in our minds of a smoke filled room where money exchanges hands and deals are cut. This is not how it works in Jefferson District Court based upon my experience. The prosecutors and defense attorneys do their best to represent their clients to the best of their abilities. I have no doubt that this happened in the case we are discussing.

Unfortunately, this was a tragic accident. No one should drink and drive and the action should never be condoned. This had to be weighed with the attorneys’ understanding that there would be no insurance proceeds available if a DUI conviction occurred. With no insurance it is much more difficult to quickly collect a judgement. The prosecutor, defense attorney and judge made a difficult call after weighing all the information available to them at the time. Everyone had input and I believe they made the best decision for this accident victim under these circumstances.

A New Trend in Car Accident Services

In July of this year the small town of Radcliff, Kentucky put into effect a new ordinance that requires payment for services after an auto accident. These services include police and fire services. Radcliff has modeled their ordinance after a similar one in effect in Erlanger, Kentucky.

Basically, the ordinance states that if you are the cause of an accident and don’t live in that city you will be charged for police and fire services. The thought process behind the ordinance is that the tax payers of the particular city should not have to pay for accidents caused by people from out of town.

After an accident in one of these cities a bill for the services are sent to a recovery service that will then bill the driver’s insurance. Some insurance companies will pay the fee but most won’t. They will then forward the bill to the driver. Many worry that insurance costs will rise due to the taxes that are surfacing in many towns across the country. According to an article in USA Today during the past few years cities in at least 15 states have passed ordinances requiring at-fault drivers to pay up.

Other concerns relate to the thought process that a driver may have after an accident, should they call the police and what will the charges be if the police respond. Lack of an accident report because of no police response can affect the speed that an accident victim receives payment for their property damage and rental car from the at-fault insurance company. The insurance adjuster will have to speak with their driver to determine fault. If there is an accident report prepared by the police a determination can be made without a statement from the at-fault driver if the cause of the accident is obvious from the report.

I have concerns with this type of procedure. Should I be taxed or charged for the police and fire department doing their job? Will this have an affect on public safety if response is based on payment? How long will it be before all at-fault drivers are charged regardless of their county of residence. What type of affect can this have on an individuals credit when they might be billed hundreds of dollars they had no idea they were incurring? I believe this is a dangerous precedent. I would like to see the statistics from the collections and the affect on the drivers as well as the cities that are imposing the fee.

I-75 Wreck Kills Two Students

Early Sunday afternoon November 9th a car carrying three college students wrecked on northbound I-75 in Rockcastle County. Two of the occupants were killed and the third has suffered multiple injuries.

The accident occurred when the car the young men were in lost control and crossed the median and hit a tractor-trailer traveling southbound. The two fatalities are Thomas B. May, a 20-year-old from Louisville, Ky and Bradley A. Hall, an 18-year-old from Rockfield. The third person has been identified as Ben M. Cooley of Harrodsburg. Cooley was transported to University of Kentucky Hospital where his condition has not been released.

The driver of the tractor-trailer was taken to Rockcastle County Hospital as a precaution. He has been identified as 51-year-old James Donaldson of Oregon, Ohio.

The three students were active in Baptist Campus Ministry at UK and were returning after a fall retreat at Laurel Lake. They will all be missed greatly.

One of the first questions that come up after a tragedy such as this is the question of seatbelts and whether the victims were wearing them. In this case all three of the occupants of the car as well as the driver of the tractor-trailer were wearing seatbelts. Recently I wrote an article and posted it on my website on the installation of cable barriers on several stretches of Kentucky highways in an effort to prevent crossover accidents. Pedestrian Fatality November 3rd

Monday evening, November 3rd at about 7 p.m. a man was hit by a car in the 3800 block of Breckinridge Lane. The victimhas been identified as 41-year-old Travis Caudell, Jr. Mr. Caudell, dressed in dark clothes was crossing the street when a car driving south struck him. He was transported to University Hospital where he died not long after arriving. The cause has not been released.

The Louisville Metro Police traffic unit is currently investigating and say that more than likely there will be no charges placed against the driver.

Automobile Industry Attempts to Protect Pedestrian From Injury and Fatality

In a news article I added to my website last week, “New Auto Designs May Help Reduce Pedestrian Injuries and Fatalities”, I outlined some information offered by a report by the National Transportation Safety Administration on automobile and pedestrian crashes. Also in this article I addressed some information on changes the automobile industry is making to their designs which should lessen the severity of injuries and fatalities to pedestrians.

Some of the changes include that instead of having hood ornaments the car emblem is imbedded in the grill or if there is a hood ornament it is designed to collapse on impact. Exterior mirrors are now mounted on springs and door handles are recessed. Hood designs are being changed as well. They are now designed to collapse on impact from above. One issue that is causing some design problems is the front bumper. Giving more crush room may interfere with the sensor which activates the interior airbags.

Paying attention and being aware of your surroundings is one way as a motorist or pedestrian to avoid crashes. Last week I put an article on my website entitled “New Auto Designs May Help Reduce Pedestrian Injuries and Fatalities”. In this article I outlined some information released in a report by National Highway Transportation Safety Administration. In this report there is some good news in trends as related to pedestrian fatality and pedestrian injuries involving motor vehicles. Since 1997 number of pedestrian fatalities has declined. Included in this report are several interesting findings.

•    More than 60% of pedestrian fatalities occurred in urban areas where the number of pedestrian traffic is higher.
•    January 1st and October 31st are the two days of the year with the highest incidences of pedestrian fatalities.
•    Males are more likely to be killed in a crash than females.
•    People in the older age group (over 64 years old) are more likely to be killed than any other age group.
•    Pedestrians are more likely to be killed in dark conditions than in light conditions.
•    Fall is the deadliest season for pedestrians.
•    Between the hours of 6 p.m. and 9 p.m. the number of pedestrian fatality is higher than any other time period.
•    The majority of drivers in pedestrian fatal accidents were males between the ages of 21 and 25 who were not speeding or drinking.

Since it is getting darker earlier pedestrians will be less visible so as a motorist it is important to be diligent in being aware of your surroundings. As a pedestrian be aware that cars may not see you and check twice before crossing the road and several times as you cross the road. Motor Vehicle Accidents on Kentucky Roads Cause Seven Deaths

Between the days of October 20th and October 26th seven people have died on Kentucky roadways. This brings the number of fatalities up to 630 for this year. Even though 630 is high it is lower than the number reported for this same time last year. At this time in last year 720 people had been killed on the roads of Kentucky.

Of the seven fatalities five were auto accidents. They occurred in Boone, Clark, Pendleton, Warren and Woodford counties. The investigations show that three of the victims were not wearing seatbelts at the time of the accidents. Investigations also indicate that one of this accidents involved suspected alcohol use.

One fatality was a motocyclist in Rowan County who at the time of the accident was not wearing a helmet. Helmets provide added protection but do not always prevent fatalities. The other fatality was a pedestrian in Daviess county.

There are many actions we can all take to reduce the number of accidents and a common thread is being aware and alert when you are behind the wheel. Deadly Truck Crash Causes State to Make Road Changes

On May 1 in Falmouth, Kentucky 16-year-old Daniel Wood was killed when a dump truck crossed the center line striking his school bus. Daniel Wood was killed instantly and ten other students were injured. Among those ten students were Daniel’s younger brother an sister.

No charges were filed against the driver and the investigation has shown the driver was traveling within the 55 mph limit. This particular stretch of road has steep hills as well as sharp curves. It has also been the site of approximately 100 accidents since January of 2005.

The family of the victim gathered almost 2,000 names on a petition for safety improvements. They also commissioned a study of the road which revealed serious safety issues with the road. The efforts of the Wood family has prompted the Kentucky Transportation Cabinet to conduct an audit of the road which found blind spots, visibility issues and sharp turns.

Since then the speed limit has been changed to 45 miles per hour along the 14 mile stretch of the road. The shoulders of the road have been built up and trees have been trimmed. There are about 15 new speed limit signs that may go up soon in hopes of reducing accidents in the future.

When driving on roads that are steep with many turns and bad visibility it is a good idea to lower your speed to give yourself more control of your vehicle. New Military Motorcycle Safety Class

As we look back on our trick-or-treating days I can remember the excitement. It was a magical night that is looked to as one of the most anticipated nights of the year. Children get to dress up and get candy. So many aspects have children looking forward to this day more than any other. What kind of costume to wear, which houses have the best candy and how to convince parents to let them stay out later.

Halloween is also the night when the number pedestrian fatalities quadruple. Kids dressed in dark costumes with masks that may cover their eyes coupled with the excitement of the night may lead to disaster. The USDOT shows that:

* Fatal collisions between motor vehicles and young pedestrians (under 15 years of age) happen most frequently between 4 p.m. and 8 p.m. — prime trick-or-treating time.
* 84% of deaths among young pedestrians occurred at non-intersection locations (indicating children are most likely to dart and dash from mid-block into the street).

Halloween is also dangerous because of the number of parties that take place. Of all the highway fatalities that take place on Halloween two-thirds of them are alcohol related. The Kentucky Office of Highway Safety has issued tips for safe driving on this dangerous night:

* Don't use a cell phone while driving through neighborhoods. A single distraction could lead to a tragedy.
* Stay well below the posted speed limit.
* Pay attention to what's happening on sidewalks and roadways. Watch for children darting across streets, especially between parked cars.
* Be extra alert when pulling in and out of driveways.
* Do not assume children can see you or are paying attention. You need to take that responsibility.
* Drivers should also check that all lights on their car work.
* Do not pass other vehicles that have stopped in the roadway. They could be dropping off children.
* If you're driving a group of children, but staying in the running vehicle at the curb, be sure to put on your hazard lights to alert other motorists.
* And if you're driving to a Halloween party, put that mask on after you park the car.

Also a few tips for parents to help drivers on Halloween night:

* Make sure drivers can see the children. Give them flashlights and glow sticks. Dress kids in bright, reflective clothing or use reflective tape on their costumes.
* Use makeup, rather than masks, so children have a clear, unobstructed view of their surroundings.
* Be sure children know how to cross a street -- look left, right and left again before crossing.
* Instruct children to stay on sidewalks and to cross only at corners or crosswalks.
* Accompany your children as they trick or treat.

Truck Accident in Irvine, Kentucky Injures Woman

Sunday, October 19 was a an almost fatal morning for a Berea woman. Amanda Parker and her husband Shannon were traveling on east Red Lick Road when the truck they were in dropped off the right shoulder of the road. In an attempt to regain control the driver overcorrected causing the vehicle to cross over into the westbound lanes before leaving the road. The truck overturned several times ejecting both the driver, Shannon Parker, and passenger Amanda Parker. The 1988 Chevy S-10 pickup truck landed on Mrs. Parker.

Mr. Parker who was injured was able to flag down another motorist to help. Jamie Neal along with his two teen age sons and Timothy Reardon were able to help pull the truck off Mrs. Parker. Mr. Neal and Mr. Parker performed CPR and mouth-to-mouth for approximately 15 minutes while they waited for emergency crews to arrive.

Mrs. Parker was flown by helicopter to the Lexington Hospital where she was listed in fair condition. Mr. Parker was taken to St. Joseph Hospital in Berea where he was treated in the emergency room.

Fatal Truck Accident in Trigg County Kentucky

Lynnea Kruger, a 67-year-old Cadiz woman died as the result of an accident on October 14 in Trigg County Kentucky. The two vehicle accident occurred when the truck driven by Mrs. Kruger’s husband attempted a left turn on U. S. Highway 68 onto Lakota Drive.

The Kruger’s truck was hit by another truck being driven by Willard Gilstrap as he was traveling in the opposite direction when his truck hit the passenger side of the Kruger’s truck. At the scene of the accident Trigg County Rescue squad had to extricate both Mr. and Mrs. Kruger from the vehicle. Mr. Kruger was airlifted from the scene to Vanderbuilt while Mrs. Kruger was taken by ambulance to Trigg County Hospital where she was pronounced dead.

Although the accident is still under investigation a report a report submitted by the Kentucky State Police indicates that Gilstrap did not have sufficient opportunity to avoid the collision.

Deer Season Can Cause More Automobile Accidents

The months of October through December can be even more hazardous on the road due to deer season. In Kentucky 2007 almost 2,800 traffic accidents involved deer. Of those near 2,800 crashes 76 resulted in injuries and three were fatal. Nationally each year these accidents kill around 150 people, injure thousands and cause over a billion dollars in vehicle damage.

During this time deer are on the move for several reasons. It is mating season, hunting season and there are more hikers in the woods. The Kentucky State Police have offered several tips for motorists to avoid hitting deer:

    * Be extra cautious in the early morning and evening hours. Deer are most active during these low-light periods when humans see worst and reaction time is slow.
    * Stay alert when driving through a known deer-crossing zone. If you see one deer, look for more. They often travel in herds.
    * Drive at a moderate speed, especially on roads bordering woodlands, parklands, golf courses and streams. However, remember that many deer crashes occur on busy highways near cities.
    * Use high beam headlights if there is no oncoming traffic. High beams will reflect in the eyes of deer on or near the roadway, providing increased driver reaction time.
    * Upon seeing a deer, immediately slow down. Do not swerve---this could confuse the deer about where to run. It could also cause you to lose control of your vehicle. It is generally safer to hit the deer than leave your lane, risking injury to passengers and other motorists.
    * Deer are often unpredictable, especially when faced with blinding headlights, loud horns and fast-moving vehicles. Don't expect them to stay where they are. They can dart in front of you at the last moment, stop in the middle of the road, cross quickly and return to the road or even move toward an approaching vehicle.
    * Deer whistles on cars provide little help and blowing the car horn doesn't always solve the problem. Blowing the horn may cause them to move, but not necessarily in the direction you want.
    * Always wear your safety belt. Historically, most people injured or killed in deer/auto collisions were not properly restrained.

As always being alert and attentive when you are driving can reduce your chances of getting into a crash on the road. Larry Hujo, School Board Member Hurt in Motorcycle Crash

Late Saturday afternoon Larry Hujo was riding his motorcycle when he collided with a car in the area of Hunsinger Lane and Six Mile Lane. The accident resulted in serious injuries for Mr. Hujo.

Hujo was traveling down Six Mile Lane when the car in front of him made a right hand turn directly in front of him. Hujo tried to stop by hitting the brakes but couldn’t stop in time and ended up crashing into the car.

Mr. Hujo’s injuries on his right side that he had to undergo seven hours of surgery to rebuild his right elbow and right shoulder. He also has seven broken ribs and a fractured kneecap. He is unsure when he will be released from the hospital. Mr. Hujo was wearing a helmet at the time of the collision but still feels his “guardian angel was with him”. This accident could have been much worse for Hujo and his family. There have been several motocycle fatalities this year in Kentucky. Some of the victims were wearing helmets and some were not. A helmet will add protection but will not always save a life or prevent serious injuries.

Bicycle Safety Initiative Announced Yesterday

Mayor Jerry Abramson along with Louisville Metro Police Department Chief Robert White announced yesterday an initiative called Keep Louisville Safe. Already this year there have been three fatalities involving bicyclists and motor vehicles. There have also been 122 collisions between cars and bikes, of those 122 there were 92 that involved injuries.

The initiative involves a series of seven public service announcements. Each of the announcements target a specific rule such as motorist having to have a three foot buffer between themselves and a cyclist when passing. The police are also producing a video to show each officer that outlines Kentucky laws for cyclist and motorists.

With the price of gas going up and more people using their bicycles for transportation both Chief White and Mayor Abramson feel these messages need to be put out. The goal is to educate both cyclist and drivers so that they can effectively learn to share the road and prevent accidents.

Enforcement of these rules may have to be stepped up on both sides. Citations should be issued to cyclists who don’t obey the laws as well as to motorists who don’t properly accommodate cyclists. We all have to work together to safely share the road.

Motorcycle Accident Takes Life of Louisville Man

Early Saturday morning a motorcyclist was killed on Brownsboro Road. The accident happened around 4 a.m. in the 2400 block of Brownsboro Road which is near Ewing Avenue.

According to witnesses the man was traveling at a high rate of speed on westbound Brownsboro Road. He apparently lost control of his motorcycle on a curve. As he lost control the motorcycle left the road and hit two sign posts. The victim was pronounced dead at the scene. Louisville Metro Police Department is investigating the accident and have issued a release that indicated the victim was wearing a helmet at the time of the accident. Helmets provide protection but are not always able to save a life. There have been several motorcycle fatalities this year in Kentucky but only little more than half of them were not wearing helmets.

Woman Killed in Hit and Run Near Southside Drive

Saturday evening a pedestrian was killed near the intersection of Southside Drive and Kingston Avenue. The 49-year old woman has been identified as Maria Ndimuzigo. Ms. Ndimuzigo lived in the 100 block of Kingston Avenue which is only blocks from the site of the accident.

The accident occurred around 8:20. The victim was taken to University Hospital where she was pronounced dead at 9:07. The cause of her death is multiple blunt force injuries.

The vehicle that hit Ms. Ndimuzigo did not stop. Police are looking for a maroon vehicle that was last seen traveling north on Southside Drive. Louisville Metro Police are requesting that anyone with information on this accident to contact them as the investigation is ongoing.

Crash on I-64 Kills Man From Owensboro, Kentucky

Yesterday at around 11:50 a.m. an accident on I-64 and Blankenbaker Parkway in Louisville, Kentucky caused the death of one and injuries to another.

Police are still investigating the automobile/truck accident and it’s causes. The crash did involve two cars and a tractor-trailer. John Ward, a 26-year old from Owensboro, Kentucky was the driver of one of the cars and died at the scene. The other injured person was the passenger in Ward’s car. The driver of the tractor-trailer and the occupants of the other car were not injured.

Young Woman Killed in Motorcycle Crash

In a motorcycle crash that occurred Tuesday evening 19-year-old Heather Jaggers was killed.

Ms. Jaggers was thrown from a motorcycle which she was a passenger at the time of the accident. She was taken to University Hospital where she later died as the result of multiple blunt force injuries. She was not wearing a helmet at the time but motorcycle accidents can be fatal even if a helmet is worn. The accident happened around 8:30 near the intersection of Outer Loop and Nash Road in Louisville, Jefferson County Kentucky and involved another car. The driver of the motorcycle also sustained injuries when he was thrown from the motorcycle but they reportedly are not life-threatening. The driver of the car was injured as well and his injuries are also reportedly non-life-threatening.

Witnesses reported to the police the motorcycle riding westbound on Outer Loop when it collided with a car trying to turn left onto eastbound Outer Loop. According to the police charges against the motorcycle driver are pending. Results from the toxicology reports need to be reviewed.

There have been several motorcycle accidents so far this year due largely to the increase in motorcycle use. Husband Charged With Manslaughter After Crash Killed His Wife

Early Sunday morning in Gallatin County, Kentucky an automobile crash
claimed the life of 62-year-old Judy Reynolds. The accident occurred at
the intersection of KY 16 and Roberts Road.

Kentucky State Police reported that 55-year-old Eugene Reynolds was
driving when he lost control of his car. The car left the road and was
airborne before it crashed against a tree. Ms. Reynolds was trapped
inside the car and was pronounced dead at the scene of the accident.

Mr. Reynolds was taken to St. Luke's hospital in Florence, Kentucky
where he was treated for non-incapacitating wounds. State Troopers have
charged him with second-degree manslaughter and driving under the
influence.

When I was a prosecutor I had the responsibility of prosecuting DUI
offenders who were responsible for fatal accidents. Losing someone to
in a fatal accident is devastating but when it could have been prevented

Louisville Bicyclist Dies After Being Struck

Jennifer Ellen Futrell died on Saturday afternoon at University Hospital. Ms. Futrell was riding her bicycle southbound on Bardstown Road Tuesday afternoon when she was struck by a passing car. She was sent to the hospital with serious injuries and died several days later. Her death was delayed because it was her wish to have her organs donated. Doctors told her family that about 100 body parts could be used to help others. Ms. Futrell was 29 years old.

Thursday evening another cyclist was struck by a car not far from where this accident occurred. The cyclist was struck on in the eastbound lane of Broadway near Baxter Avenue when the driver of a 1992 Buick Riveria struck her from behind. She was sent to the hospital with non-life threatening injuries. The driver, Robert Kahafer, fled the scene and was later arrested. He has been charged with leaving the scene of an accident, possession of a controlled substance, possession of marijuana, having an open container in the vehicle, lacking insurance and failing to notify the transportation department of an address change.

With the cost of gas going up there will be more cyclist, motorcyclists and scooters on the road. Anytime you take to the road whether it be in an automobile or bicycle awareness is one of the best preventions.

Two Motorcycle Accidents in Kentucky Over the Weekend Claim the lives of Two Men and One Horse

In two separate motorcycle accidents over the weekend in Kentucky two men have lost their lives.

Edward Garner died on Saturday night in Madison County when apparently his motorcycle left the road and hit an embankment. He was transported to Pattie A. Clay Medical Center where he later died as a result of the injuries from the accident. Mr. Garner was 50-years-old and from Richmond, Kentucky.

In a separate accident in Carlisle county 44 year-old Garrett Warfield was also killed while riding a motorcycle. Mr. Warfield was carrying an 11 year old passenger at the time of the accident who suffered injuries to her lower extremities. She was transported to a hospital in Missouri. The accident occurred when the motorcycle hit a horse on Kentucky Route 8-49 West. The horse also died in the crash. It has not been reported as to whether any of the victims were wearing helmets.

Woman Killed and Toddler Injured on Interstate 64

Monday night a 21-year-old woman identified as Christina Hughes was killed on I-64 near the Watterson Expressway, in Louisville, Jefferson County, Kentucky. She was traveling west on I-64 when she lost control of her car, the car then overturned. Ms Hughes was pronounced dead at the scene. Also in the car was a three year old child who was transported to Kosair Children’s Hospital. The child’s condition has not been released. An investigation is pending but it can be noted that police are looking at whether speed may have been a factor in this fatal accident. It has not been reported as to whether Ms. Hughes was wearing a seat belt at the time of the accident or what kind of restraints the child may have been in at the time of the accident.

Interstates are dangerous places. You have several vehicles weighing tons traveling at speeds of 55 miles per hour and usually faster than that. Automobile accidents are devastating and even more so when someone has lost their life. Bicyclist Hit on Bardstown Road Suffers Life Threatening Injuries

On Tuesday afternoon around 3:30 a woman riding a bike down Bardstown Road near the Grinstead Drive intersection was struck by a passing van and was transported to the hospital. Both the van and the bicyclist were in the right hand lane traveling south. The identities of both the driver and the injured woman have not been released. It has not been reported as to whether the woman was wearing a helmet at the time of the accident. The investigation is still on-going which will include, among other thing, toxicology tests. No charges have been filed against the driver of the van.

Many people don’t realize that there are several rules for both bicyclists and motorists that are intended to insure the safety of the many cyclist on Kentucky roads. One of the rules for cyclists is they must use the bicycle lane if there is one available. The Kentucky Driver's Manual suggests that a motorist when passing a cyclist should only pass when there is at least three feet between their vehicle and the cyclist. It should also be noted that bicyclists are not allowed to ride on the sidewalks.

As a bicyclists myself I have had many instances where vehicles have come very close to hitting me. I urge all drivers to be careful and aware of bicycles on the road. Both the cyclist and driver of a motor vehicle must obey the same rules of the road. By doing this and being aware of the presence of others on the roadways many of these accidents can be prevented. In these types of accidents it is always the cyclist who suffers the most.

Ways to Avoid Fatigued Driving

Driving while fatigued, just like driving under the influence of alcohol or drugs, can be hazardous and can lead to an auto accident. When a person is sleepy their reaction time is slower, their awareness is less acute, judgement is impaired and in some cases the driver experiences increased aggression. All of these factors indicate a dangerous driver. The National Highway Traffic Safety Administration has reported that fatigue is the cause of almost 100,000 accidents every year. Of those 1,500 people are killed in these accidents and 71,000 are injured. There are ways to prevent falling asleep while driving.

•    Stop driving if you feel sleepy. Drink a caffeinated beverage but wait 30 minutes or so before taking the wheel again. That’s how long it takes for the caffeine to enter the bloodstream.. You may use that 30 minutes to take a short nap.
•    Get lots of sleep the night before taking a long trip. The more the better.
•    Don’t plan on working all day then driving all night
•    Drive at times when you are normally awake.
•    Avoid driving at “sleepy times” of the day. Take a middy break for a short nap and find a place to sleep between midnight and dawn.
•    Avoid foods that are high in carbohydrates, they can make a person sleepy. Opt for foods with high protein levels.
•    Avoid medications that make you sleepy such as cold and flu medications.
•    When driving long trips keep an awake passenger in the front seat with you. A loud radio is no substitute for actual conversation.
•    Take a break every two hours or so even if you feel you don’t need it. Get out of the car and take deep breaths and maybe some stretching exercises.
•    Try to set a limit of 300 to 400 miles a day.

No matter how a person is impaired an impaired driver can make mistakes that can cause severe injury or death to the driver, passengers and even strangers. Always be aware of how you feel and be responsible for your actions. Taking precautions to avoid an automobile accident by not being a fatigued driver may save your life.

Sleep Related Crashes

Three years ago in Wisconsin a bus carrying high school students crashed
into an overturned tractor trailer killing five people. The National
Transportation Safety Board investigated the crash and determined the
driver of the tractor trailer had fallen asleep while driving. He
drifted off the side of the road then swerved to get back onto the
highway causing his rig to overturn. The bus traveling behind the
truck was not able to avoid the accident and crashed into the truck.

The NTSB has suggested that trucking companies work harder insuring
their drivers get adequate rest while traveling long distances on the
road. They have asked the Federal Motor Carrier Safety Administration
to be more aggressive in insuring the trucking companies records are
kept up to date as well as the drivers diligently filling their log
books. A driver is allowed to drive for 11 hours only after 10 hours of
off duty time and their log book is a record of their time on the road, off the road and sleeping times.

There is also technology in the very early stages that may reduce
fatigue induced crashes. An dash mounted camera is in the works that
will track eye and eyelid movement and will sound an alert if the driver
appears to be nodding off. Since drivers are often not aware of their
fatigue this could be beneficial. Several luxury cars now have similar
options available for their cars

So many automobile accidents are the result of a drivers lack of
responsibility. It is the drivers responsibility to drive only when
rested and to not drive when they are fatigued.

Fatalities on Kentucky Roadways

The week of September 15 through September21 was deadly on Kentucky
roads. Statistics out of Frankfort, Ky indicate that seven people died
in seven different accidents. the fatalities occurred in Hancock,
Hopkins, Mason, Pike, Trimble, Union and Jackson Counties

Five of the crashes were motor vehicle accidents and four of the victims
were not wearing seatbelts. So far this year there have been 409 motor
vehicle fatalities on the roads of Kentucky. Of those 409 fatalities
254 of the victims were not wearing seatbelts.

There was one motorcycle fatality during this time period. The victim
involved was not wearing a helmet at the time of the accident. There
have been 70 motorcycle fatalitiies so far this year and of the 70
victims 43 were not wearing helmets.

There was also one ATV accident where the victim crashed into a barbed
wire fence. The victim was not wearing a helmet at the time and alcohol
use is suspected in this accident. This year the number of ATV
fatalities is 18 and 17 of those victims were not wearing helmets.

This year in Kentucky there have been a total of 545 fatalities on
Kentucky roads but that is dowm by 82 from 2007. Of the 545 fatalities
only 108 have been the result of alcohol use.

The week of July 28 through August 3 of this year was also a deadly week in Kentucky. There were 16 fatalities on Kentucky roads. Twelve of the 16 were motorvrhicle accidents, nine of the victims were not wearing seatbelts. Two were ATV accidents and neither of those victims were wearing helmets. One motorcycle acccident claimed a life, the victim was not wearing a helmet. There was also one pedestrian killed. In five of the accidents alcohol was suspected as a factor.

Traumatic Brain Injuries (TBI) are the result of a

Two TARC Accidents This Week Send Pedestrians to Hospital

Monday evening around 6:00 p.m. a man was hit by a TARC bus while crossing the street at 4th Street and Market Street. Wednesday morning at the same intersection a woman was also struck by a TARC bus. The conditions of the victims have not been released but both were transported to the hospital with injuries. Neither of the victim’s identities has been released as investigations are still on going.

The accident that occurred on Monday evening has investigators relying on physical evidence to determine what exactly happened. Initially, witnesses as well as the driver of the bus, claimed the victim was not paying attention and was not in the crosswalk when the accident happened. Since then another witness, a passenger on the bus at the time of the accident, has come forward and said the victim was clearly in the crosswalk when the bus struck him. Also, one witness said the bus tried to stop before striking the victim while the other witness has said that there was no attempt to stop the bus.

A TARC representative has said that all drivers are trained on pedestrian safety particularly in areas where there is a high concentration of pedestrians. The intersection of 4th and Market Streets is one of those areas being that it is in front of the convention center. Before this week there have been three pedestrians hit this year by TARC busses.

Having represented pedestrians that have been hit by cars and busses in the past I know the severe damage that can be done by this type of accident. I urge you not to assume that a car or a bus is going o stop just because you are in the crosswalk or have the light in your favor. Watch out for your own safety. Louisville Metro Police Officer Involved in Crash

An officer from the 4th District of the Louisville Metro Police Department was involved in an accident early this morning. As a result of the crash he was taken to University Hospital with injuries to his head. It has not been released how critical his injuries are. Nor has his identity been released, that information will be released today. The driver of the other also suffered injuries but were minor and he was not taken for treatment.

The accident happened near Preston and Caldwell Streets, which is in the area known as Smoketown. The officer was reportedly responding to a call involving an individual who had been robbed. The officer was traveling westbound on Caldwell Street when the driver of the other car, which was northbound on Preston Street hit the officer.

An investigation is being conducted by the traffic unit of the Louisville Metro Police Department. It has been indicated that at the time of the accident the police car did not have the lights and siren on.

There is not a traffic light at this particular intersection so extreme caution needs to be observed. Does Back Pain Need Surgery?

Almost everyone in their life has suffered some form of backache.
