		<title>American Association for Justice Report on Insurance Company Tactics</title>
		<description><![CDATA[The American Association for Justice (AAJ) is a judicial organization that has been around for over 60 years. They were formally known as the American Trial Lawyers Association. 		<title>Trimble County Man Arrested in Fatal Accident</title>
		<description><![CDATA[In an accident on U.S. 421 Jose Luis Benitez of Milton, Ky was killed and three other were injured.&nbsp; The accident occurred when Herberto Rodriguez was driving northbound on U.S. and attempted a left turn into a parking lot.&nbsp; A 2000 GMC pickup was traveling southbound on the same road and was not able to avoid striking Rodriguez&rsquo;s car on the passenger side.<br /><br />Benitez was in the passenger side of the back seat at the time of the collision and was pronounced dead at the scene.&nbsp; The other passengers in Rodriguez&rsquo;s car, Julio Hernandez, age 34, and Sixto Hernandez, age 20 sustained minor injuries.&nbsp; The driver of the pickup truck, Lori Howdyshell of Milton, also received minor injuries.<br /><br />Rodriguez was treated for minor injuries at Carroll County Memorial Hospital then transported to the Carroll County Regional Detention Center where he was charged with driving under the influence as well as manslaughter.&nbsp; Kentucky State Police reported that none of the victims in Rodriguez&rsquo;s were wearing seatbelts at the time of the accident.&nbsp; The investigation is ongoing.<br /><br />For more information on Louisville, Kentucky personal injury attorney Mike Schafer go to <a href="http://mikeschaferlaw.com/" target="_blank">www.mikeschaferlaw.com</a>.]]></description>

		<title>Another Pedestrian Fatality on Jefferson County Roads</title>
		<description><![CDATA[Thursday evening around 6:45 on Dixie Highway 58-year-old Clara Watts was struck while attempting to cross the road.&nbsp; This occurred near the intersection of Dixie and Lewiston Place.&nbsp; After being struck Ms. Watts was transported to University Hospital where she died not long after she arrived.<br /><br />The investigation shows that a Ford was traveling northbound on Dixie Highway when Ms. Watts stepped into the car&rsquo;s path.&nbsp; The investigation also reports that Ms. Watts was wearing dark clothes at the time of the accident.&nbsp; Louisville Metro Police Department Traffic Unit has reported that no charges are expected to be filed against the driver of the Ford.<br /><br />This is a dangerous time of the year for <a href="http://mikeschaferlaw.com/blog/pedestrian-fatalities-and-injuries.cfm" target="_blank">pedestrians</a>&nbsp; as it is getting darker earlier.&nbsp; Particularly during rush hour when drivers may be more distracted pedestrians need exercise more <a href="http://mikeschaferlaw.com/blog/pedestrian-fatalities-and-injuries.cfm" target="_blank">caution</a>.&nbsp; <br /><br />For more information on Louisville, Kentucky personal injury attorney Mike Schafer go to <a href="http://mikeschaferlaw.com/" target="_blank">www.mikeschaferlaw.com</a>.&nbsp;]]></description>

		<title>Four Dead in South Central Kentucky Auto Accident</title>
		<description><![CDATA[On October 14th in Clinton County Ky. An accident immediately claimed the lives of three, almost two weeks later a fourth victim died at University of Kentucky Hospital.<br /><br />The accident occurred on US 127 approximately two miles south of Albany, Ky.&nbsp; Shortly before 8 p.m. on south US 127 a vehicle being driven by 29-year-old Candi Byers lost control.&nbsp; The car slid into the northbound lane and struck a 2004 Ford Ranger Pickup.&nbsp; In the car with Byers was another passenger, 3-year-old Kasen Byers.&nbsp; Both were pronounced dead at the scene.&nbsp; The passenger in the pickup, 48-year-old Belinda Logan, was also pronounced dead at the scene.&nbsp; The driver of the pickup, 44-year-old Brenda Logan, suffered serious injuries and was flown to University Hospital in Lexington, Ky.&nbsp; Brenda Logan died on October 26th at University of Kentucky Hospital.&nbsp; <br /><br />This fatal accident was investigated by the Kentucky State Police.&nbsp; It has been reported that none of the adult victims were wearing seatbelts and the child was not in a car seat&nbsp; at the time of the accident. 		<title>Felony DUI Charges Reduced</title>
		<description><![CDATA[Local insurance agency owner Robert Clarkson was driving while under the influence of alcohol in June of this year.&nbsp; While driving under the influence he hit a motorcyclist causing several injuries.&nbsp; Clarkson was facing felony assault charges as well as DUI charges.&nbsp; During the prosecution process the prosecutors offered to amend the felony charge to a misdemeanor charge of careless driving.<br /><br />The victim in this particular case had no objection to the plea agreement. A felony conviction would have impacted Clarkson&rsquo;s insurance policy which was a multimillion dollar policy.&nbsp; Despite this, the Jefferson County Attorney made a motion to set aside the plea agreement and to allow the case to proceed to trial. The Jefferson District Court Judge denied the motion and let the plea deal stand. <br /><br />Plea deals have received a bad rap over the years. Many of us have the picture in our minds of a smoke filled room where money exchanges hands and deals are cut. This is not how it works in Jefferson District Court based upon my experience. The prosecutors and defense attorneys do their best to represent their clients to the best of their abilities. I have no doubt that this happened in the case we are discussing. <br /><br />Unfortunately, this was a tragic accident. No one should drink and drive and the action should never be condoned. This had to be weighed with the attorneys&rsquo; understanding that there would be no insurance proceeds available if a DUI conviction occurred. With no insurance it is much more difficult to quickly collect a judgement. The prosecutor, defense attorney and judge made a difficult call after weighing all the information available to them at the time. 		<title>A New Trend in Car Accident Services</title>
		<description><![CDATA[In July of this year the small town of Radcliff, Kentucky put into effect a new ordinance that requires payment for services after an auto accident.&nbsp; These services include police and fire services.&nbsp; Radcliff has modeled their ordinance after a similar one in effect in Erlanger, Kentucky.<br /><br />Basically, the ordinance states that if you are the cause of an accident and don&rsquo;t live in that city you will be charged for police and fire services.&nbsp; The thought process behind the ordinance is that the tax payers of the particular city should not have to pay for accidents caused by people from out of town.&nbsp; <br /><br />After an accident in one of these cities a bill for the services are sent to a recovery service that will then bill the driver&rsquo;s insurance.&nbsp; Some insurance companies will pay the fee but most won&rsquo;t. They will then forward the bill to the driver.&nbsp; Many worry that insurance costs will rise due to the taxes that are surfacing in many towns across the country.&nbsp; According to an article in <a href="http://www.usatoday.com/news/nation/2008-01-28-accidentbills_N.htm" target="_blank">USA Today</a> during the past few years cities in at least 15 states have passed ordinances requiring at-fault drivers to pay up.<br /><br />Other concerns relate to the thought process that a driver may have after an accident, should they call the police and what will the charges be if the police respond.&nbsp; Lack of an accident report because of no police response can affect the speed that an accident victim receives payment for their property damage and rental car from the at-fault insurance company. The insurance adjuster will have to speak with their driver to determine fault. If there is an accident report prepared by the police a determination can be made without a statement from the at-fault driver if the cause of the accident is obvious from the report.<br /><br />I have concerns with this type of procedure. Should I be taxed or charged for the police and fire department doing their job?&nbsp; Will this have an affect on public safety if response is based on payment? How long will it be before all at-fault drivers are charged regardless of their county of residence. What type of affect can this have on an individuals credit when they might be billed hundreds of dollars they had no idea they were incurring? I believe this is a dangerous precedent. 		<title>Remember to Put Your Flag out for Veteran?s Day</title>

		<title>I-75 Wreck Kills Two Students</title>
		<description><![CDATA[Early Sunday afternoon November 9th&nbsp; a car carrying three college students wrecked on northbound I-75 in Rockcastle County.&nbsp; Two of the occupants were killed and the third has suffered multiple injuries.<br /><br />The accident occurred when the car the young men were in lost control and crossed the median and hit a tractor-trailer traveling southbound.&nbsp; The two fatalities are Thomas B. May, a 20-year-old from Louisville, Ky and Bradley A. Hall, an 18-year-old from Rockfield.&nbsp; The third person has been identified as Ben M. Cooley of Harrodsburg.&nbsp; Cooley was transported to University of Kentucky Hospital where his condition has not been released.<br /><br />The driver of the tractor-trailer was taken to Rockcastle County Hospital as a precaution.&nbsp; He has been identified as 51-year-old James Donaldson of Oregon, Ohio.<br /><br />The three students were active in <a href="http://www.uky.edu/StudentOrgs/BSU/" target="_blank">Baptist Campus Ministry</a> at UK and were returning after a fall retreat at Laurel Lake.&nbsp; They will all be missed greatly.<br /><br />One of the first questions that come up after a tragedy such as this is the question of seatbelts and whether the victims were wearing them.&nbsp; In this case all three of the occupants of the car as well as the driver of the tractor-trailer were wearing seatbelts.&nbsp; Recently I wrote an article and posted it on my website on the installation of <a href="http://mikeschaferlaw.com/news.cfm" target="_blank">cable barriers</a> on several stretches of Kentucky highways in an effort to prevent crossover accidents.&nbsp; There have been many fatalities in Kentucky that have been attributed to <a href="http://mikeschaferlaw.com/blog/?catid=1045" target="_blank">crossover accidents</a>.&nbsp; Hopefully these cable barriers will go up along more highway stretches in the future.&nbsp; For more information on Louisville, Ky personal injury attorney Mike Schafer go to <a href="http://mikeschaferlaw.com/" target="_blank">www.mikeschaferlaw.com</a>.]]></description>

		<title>Pedestrian Fatality November 3rd</title>

		<title>Automobile Industry Attempts to Protect Pedestrian From Injury and Fatality</title>
		<description><![CDATA[In a news article I added to my website last week, &ldquo;<a href="http://mikeschaferlaw.com/news.cfm#News6167" target="_blank">New Auto Designs May Help Reduce Pedestrian Injuries and Fatalities</a>&rdquo;, I outlined some information offered by a report by the <a href="http://www.nhtsa.dot.gov/portal/site/nhtsa/menuitem.6a6eaf83cf719ad24ec86e10dba046a0/" target="_blank">National Transportation Safety Administration </a>on automobile and pedestrian crashes.&nbsp; Also in this article I addressed some information on changes the automobile industry is making to their designs which should lessen the severity of injuries and fatalities to pedestrians.<br /><br />Some of the changes include that instead of having hood ornaments the car emblem is imbedded in the grill or if there is a hood ornament it is designed to collapse on impact.&nbsp; Exterior mirrors are now mounted on springs and door handles are recessed.&nbsp; Hood designs are being changed as well.&nbsp; They are now designed to collapse on impact from above.&nbsp; One issue that is causing some design problems is the front bumper.&nbsp; Giving more crush room may interfere with the sensor which activates the interior airbags.&nbsp; <br /><br />Paying attention and being aware of your surroundings is one way as a motorist or pedestrian to avoid crashes. Technological advances are important to pedestrian , as well as bicycle, safety in these accidents. However, these advances will only decrease the severity of injuries sustained in these accidents. Prevention is still the best way to avoid serious injuries. 		<description><![CDATA[Last week I put an article on my website entitled &ldquo;<a href="http://mikeschaferlaw.com/news.cfm#News6167" target="_blank">New Auto Designs May Help Reduce Pedestrian Injuries and Fatalities</a>&rdquo;.&nbsp; In this article I outlined some information released in a report by <a href="http://www.nhtsa.dot.gov/portal/site/nhtsa/menuitem.6a6eaf83cf719ad24ec86e10dba046a0/" target="_blank">National Highway Transportation Safety Administration</a>.&nbsp; In this report there is some good news in&nbsp; trends as related to pedestrian fatality and pedestrian injuries involving motor vehicles.&nbsp; Since 1997 number of pedestrian fatalities has declined.&nbsp; Included in this report are several interesting findings.<br /><br />&bull;&nbsp;&nbsp;&nbsp; More than 60% of pedestrian fatalities occurred in urban areas where the number of pedestrian traffic is higher.&nbsp; <br />&bull;&nbsp;&nbsp;&nbsp; January 1st and October 31st are the two days of the year with the highest incidences of pedestrian fatalities.<br />&bull;&nbsp;&nbsp;&nbsp; Males are more likely to be killed in a crash than females.<br />&bull;&nbsp;&nbsp;&nbsp; People in the older age group (over 64 years old) are more likely to be killed than any other age group.<br />&bull;&nbsp;&nbsp;&nbsp; Pedestrians are more likely to be killed in dark conditions than in light conditions.<br />&bull;&nbsp;&nbsp;&nbsp; Fall is the deadliest season for pedestrians.<br />&bull;&nbsp;&nbsp;&nbsp; Between the hours of 6 p.m. and 9 p.m. the number of pedestrian fatality is higher than any other time period.<br />&bull;&nbsp;&nbsp;&nbsp; The majority of drivers in pedestrian fatal accidents were males between the ages of 21 and 25 who were not speeding or drinking.<br /><br />Since it is getting darker earlier pedestrians will be less visible so as a motorist it is important to be diligent in being aware of your surroundings.&nbsp; As a pedestrian be aware that cars may not see you and check twice before crossing the road and several times as you cross the road.&nbsp; Being struck by a car can lead to injuries that can effect you for the rest of your life.&nbsp;&nbsp; Losing a loved one to a pedestrian fatality can haunt you as well.&nbsp; Be safe as a motorist and a pedestrian.&nbsp; For more information on Louisville, Kentucky personal injury attorney Mike Schafer go to <a href="http://mikeschaferlaw.com/" target="_blank">www.mikeschaferlaw.com</a>.]]></description>

		<title>Motor Vehicle Accidents on Kentucky Roads Cause Seven Deaths</title>
		<description><![CDATA[Between the days of October 20th and October 26th seven people have died on Kentucky roadways.&nbsp; This brings the number of fatalities up to 630 for this year. Even though 630 is high it is lower than the number reported for this same time last year.&nbsp; At this time in last year 720 people had been killed on the roads of Kentucky.<br /><br />Of the seven fatalities five were auto accidents.&nbsp; They occurred in Boone, Clark, Pendleton, Warren and Woodford counties.&nbsp; The investigations show that three of the victims were not wearing seatbelts at the time of the accidents. 		<title>Deadly Truck Crash Causes State to Make Road Changes</title>
		<description><![CDATA[On May 1 in Falmouth,&nbsp; Kentucky 16-year-old Daniel Wood was killed when a dump truck crossed the center line striking his school bus.&nbsp; Daniel Wood was killed instantly and ten other students were injured.&nbsp; Among those ten students were Daniel&rsquo;s younger brother an sister.&nbsp; <br /><br />No charges were filed against the driver and the investigation has shown the driver was traveling within the 55 mph limit.&nbsp; This particular stretch of road has steep hills as well as sharp curves.&nbsp; It has also been the site of approximately 100 accidents since January of 2005.<br /><br />The family of the victim gathered almost 2,000 names on a petition for safety improvements.&nbsp; They also commissioned a study of the road which revealed serious safety issues with the road.&nbsp; The efforts of the Wood family has prompted the <a href="http://transportation.ky.gov/highways/" target="_blank">Kentucky Transportation Cabinet </a>to conduct an audit of the road which found blind spots, visibility issues and sharp turns.<br /><br />Since then the speed limit has been changed to 45 miles per hour along the 14 mile stretch of the road.&nbsp; The shoulders of the road have been built up and trees have been trimmed.&nbsp;&nbsp; There are about 15 new speed limit signs that may go up soon in hopes of reducing accidents in the future. <br /><br />When driving on roads that are steep with many turns and bad visibility it is a good idea to lower your speed to give yourself more control of your vehicle.&nbsp; Car accidents can be painful both emotionally and physically.&nbsp; For more information on Louisville, Kentucky personal injury attorney Mike Schafer go <a href="http://mikeschaferlaw.com/" target="_blank">to www.mikeschaferlaw.com</a>.]]></description>

		<title>New Military Motorcycle Safety Class</title>
		<description><![CDATA[Due to such a high number of motorcycle fatalities the <a href="http://www.safetycenter.navy.mil/toolbox/traffic/motorcycles/default.htm" target="_blank">Navy</a> and <a href="http://www.motorcycle.com/news/motorcycle-training-for-us-military-86877.html" target="_blank">Marines</a> have created a special training mandatory for sport bike riders.&nbsp; Sport bikes (motorcycles) differ from cruising motorcycles in that they are faster, up to 160 miles per hour, and easier to maneuver.&nbsp; <br /><br />Within the past year 58 sailors and Marines have been killed on motorcycles and 50 of the 58 were on sport bikes.&nbsp; The <a href="http://combattingaggressivedriving.com/cycle.php" target="_blank">Army</a>, which has a similar program, has had 36 soldiers die within the same time period on sport bikes.&nbsp; The causes of the accidents have followed a pattern which includes excessive speed, poor cornering and insufficient braking.&nbsp; It should be noted that there has been no link to combat training and these accidents and is difficult to pinpoint a specific cause.<br /><br />These courses make sense.&nbsp; Before a person gets a drivers license they need to pass a written test, have a learning permit period then pass a road test. 		<description><![CDATA[As we look back on our trick-or-treating days I can remember the excitement.&nbsp; It was a magical night that is looked to as one of the most anticipated nights of the year.&nbsp; Children get to dress up and get candy.&nbsp; So many aspects have children looking forward to this day more than any other.&nbsp; What kind of costume to wear, which houses have the best candy and how to convince parents to let them stay out later.&nbsp; <br /><br />Halloween is also the night when the number pedestrian fatalities quadruple.&nbsp; Kids dressed in dark costumes with masks that may cover their eyes coupled with the excitement of the night may lead to disaster.&nbsp; The <a href="http://www.nhtsa.dot.gov/people/injury/alcohol/StopImpaired/planners/HallowMiniPlanner05Web/pages/OpEd.htm" target="_blank">USDOT</a> shows that: <br />&nbsp;<br />* Fatal collisions between motor vehicles and young pedestrians (under 15 years of age) happen most frequently between 4 p.m. and 8 p.m. &mdash; prime trick-or-treating time.<br />* 84% of deaths among young pedestrians occurred at non-intersection locations (indicating children are most likely to dart and dash from mid-block into the street).<br /><br />Halloween is also dangerous because of the number of parties that take place.&nbsp; Of all the highway fatalities that take place on Halloween two-thirds of them are alcohol related.&nbsp; The <a href="http://highwaysafety.ky.gov/news_200810_halloween.asp" target="_blank">Kentucky Office of Highway Safety </a>has issued tips for safe driving on this dangerous night:<br /><br />* Don't use a cell phone while driving through neighborhoods. A single distraction could lead to a tragedy.<br />* Stay well below the posted speed limit.<br />* Pay attention to what's happening on sidewalks and roadways. Watch for children darting across streets, especially between parked cars.<br />* Be extra alert when pulling in and out of driveways.<br />* Do not assume children can see you or are paying attention. You need to take that responsibility.<br />* Drivers should also check that all lights on their car work.<br />* Do not pass other vehicles that have stopped in the roadway. They could be dropping off children.<br />* If you're driving a group of children, but staying in the running vehicle at the curb, be sure to put on your hazard lights to alert other motorists.<br />* And if you're driving to a Halloween party, put that mask on after you park the car.<br /><br />Also a few tips for parents to help drivers on Halloween night:<br /><br />* Make sure drivers can see the children. Give them flashlights and glow sticks. Dress kids in bright, reflective clothing or use reflective tape on their costumes.<br />* Use makeup, rather than masks, so children have a clear, unobstructed view of their surroundings.<br />* Be sure children know how to cross a street -- look left, right and left again before crossing.<br />* Instruct children to stay on sidewalks and to cross only at corners or crosswalks.<br />* Accompany your children as they trick or treat.<br /><br />Watch out for ghosts, goblins and skeletons on Halloween.&nbsp; Safety is paramount any night but especially on All Hallows Eve.&nbsp; Have a safe Halloween. 		<title>Truck Accident in Irvine, Kentucky Injures Woman</title>
		<description><![CDATA[Sunday, October 19 was a an almost fatal morning for a Berea woman.&nbsp; Amanda Parker and her husband Shannon were traveling on east Red Lick Road when the truck they were in dropped off the right shoulder of the road.&nbsp; In an attempt to regain control the driver overcorrected causing the vehicle to cross over into the westbound lanes before leaving&nbsp; the road.&nbsp; The truck overturned several times ejecting both the driver, Shannon Parker, and passenger Amanda Parker.&nbsp; The 1988 Chevy S-10 pickup truck landed on Mrs. Parker.&nbsp; <br /><br />Mr. Parker who was injured was able to flag down another motorist to help.&nbsp; Jamie Neal along with his two teen age sons and Timothy Reardon were able to help pull the truck off Mrs. Parker.&nbsp; Mr. Neal and Mr. Parker performed CPR and mouth-to-mouth for approximately 15 minutes while they waited for emergency crews to arrive.<br /><br />Mrs. Parker was flown by helicopter to the Lexington Hospital where she was listed in fair condition.&nbsp; Mr. Parker was taken to St. Joseph Hospital in Berea where he was treated in the emergency room.&nbsp; <br /><br />In a report filed by The Kentucky State Police safety restraints were not in use at the time of the accident.&nbsp; For more information on Louisville, Kentucky personal injury attorney Mike Schafer go to <a href="http://mikeschaferlaw.com/" target="_blank">www.mikeschaferlaw.com</a>.]]></description>

		<title>Fatal Truck Accident in Trigg County Kentucky</title>
		<description><![CDATA[Lynnea Kruger, a 67-year-old Cadiz woman died as the result of an accident on October 14 in Trigg County Kentucky. The two vehicle accident occurred when the truck driven by Mrs. Kruger&rsquo;s husband attempted a left turn on U. S. Highway 68 onto Lakota Drive.<br /><br />The Kruger&rsquo;s truck was hit by another truck being driven by Willard Gilstrap as he was traveling in the opposite direction when his truck hit the passenger side of the Kruger&rsquo;s truck. 		<title>Deer Season Can Cause More Automobile Accidents</title>
		<description><![CDATA[The months of October through December can be even more hazardous on the road due to deer season.&nbsp; In Kentucky 2007 almost 2,800 traffic accidents involved deer.&nbsp; Of those near 2,800 crashes 76 resulted in injuries and three were fatal. Nationally each year these accidents kill around 150 people, injure thousands and cause over a billion dollars in vehicle damage.<br /><br />During this time deer are on the move for several reasons.&nbsp; It is mating season, hunting season and there are more hikers in the woods.&nbsp; <a href="http://www.kentuckystatepolice.org/2006/press/pr10_18_06.htm" target="_blank">The Kentucky State Police</a> have offered several tips for motorists to avoid hitting deer:<br /><br />&nbsp;&nbsp;&nbsp; * Be extra cautious in the early morning and evening hours. Deer are most active during these low-light periods when humans see worst and reaction time is slow.<br />&nbsp;&nbsp;&nbsp; * Stay alert when driving through a known deer-crossing zone. If you see one deer, look for more. They often travel in herds.<br />&nbsp;&nbsp;&nbsp; * Drive at a moderate speed, especially on roads bordering woodlands, parklands, golf courses and streams. However, remember that many deer crashes occur on busy highways near cities.<br />&nbsp;&nbsp;&nbsp; * Use high beam headlights if there is no oncoming traffic. High beams will reflect in the eyes of deer on or near the roadway, providing increased driver reaction time.<br />&nbsp;&nbsp;&nbsp; * Upon seeing a deer, immediately slow down. Do not swerve---this could confuse the deer about where to run. It could also cause you to lose control of your vehicle. It is generally safer to hit the deer than leave your lane, risking injury to passengers and other motorists.<br />&nbsp;&nbsp;&nbsp; * Deer are often unpredictable, especially when faced with blinding headlights, loud horns and fast-moving vehicles. Don't expect them to stay where they are. They can dart in front of you at the last moment, stop in the middle of the road, cross quickly and return to the road or even move toward an approaching vehicle.<br />&nbsp;&nbsp;&nbsp; * Deer whistles on cars provide little help and blowing the car horn doesn't always solve the problem. Blowing the horn may cause them to move, but not necessarily in the direction you want.<br />&nbsp;&nbsp;&nbsp; * Always wear your safety belt. 		<description><![CDATA[Late Saturday afternoon Larry Hujo was riding his motorcycle when he collided with a car in the area of Hunsinger Lane and Six Mile Lane.&nbsp; The accident resulted in serious injuries for Mr. Hujo.&nbsp; <br /><br />Hujo was traveling down Six Mile Lane when the car in front of him made a right hand turn directly in front of him.&nbsp; Hujo tried to stop by hitting the brakes but couldn&rsquo;t stop in time and ended up crashing into the car.&nbsp; <br /><br />Mr. Hujo&rsquo;s injuries on his right side that he had to undergo seven hours of surgery to rebuild his right elbow and right shoulder.&nbsp; He also has seven broken ribs and a fractured kneecap.&nbsp; He is unsure when he will be released from the hospital.&nbsp; Mr. Hujo was wearing a helmet at the time of the collision but still feels his &ldquo;guardian angel was with him&rdquo;.&nbsp; This accident could have been much worse for Hujo and his family.&nbsp; There have been several motocycle fatalities this year in Kentucky.&nbsp; Some of the victims were wearing <a href="http://mikeschaferlaw.com/blog/several-motorcycle-fatalities-in-kentucky-counties-in-past-week.cfm" target="_blank">helmets</a> and some were not.&nbsp; A helmet will add protection but will not always save a life or prevent serious injuries.<br /><br />This is another example as to why all people traveling on the roadways need to be fully attentive to their surroundings.&nbsp; Motorists, motorcyclists, bicyclists and pedestrians are everywhere.&nbsp; Checking twice is always a good policy.<br /><br />For more information on Louisville, Kentucky lawyer Mike Schafer go to <a href="http://mikeschaferlaw.com/" target="_blank">www.mikeschaferlaw.com</a>.]]></description>

		<title>Bicycle Safety Initiative Announced Yesterday</title>
		<description><![CDATA[Mayor Jerry Abramson along with Louisville Metro Police Department Chief Robert White announced yesterday an initiative called Keep Louisville Safe.&nbsp; Already this year there have been three fatalities involving bicyclists and <a href="http://mikeschaferlaw.com/blog/louisville-bicyclist-dies-after-being-struck.cfm" target="_blank">motor vehicles</a>.&nbsp; There have also been 122 collisions between cars and bikes, of those 122 there were 92 that involved injuries.<br /><br />The initiative involves a series of seven public service announcements.&nbsp; Each of the announcements target a specific rule such as motorist having to have a three foot buffer between themselves and a cyclist when passing.&nbsp; The police are also producing a video to show each officer that outlines Kentucky laws for cyclist and motorists.<br /><br />With the price of gas going up and more people using their bicycles for transportation both Chief White and Mayor Abramson feel these messages need to be put out.&nbsp; The goal is to educate both cyclist and drivers so that they can effectively learn to share the road and prevent accidents.<br /><br />Enforcement of these rules may have to be stepped up on both sides.&nbsp; Citations should be issued to cyclists who don&rsquo;t obey the laws as well as to motorists who don&rsquo;t properly accommodate cyclists.&nbsp; We all have to work together to safely share the road.<br /><br />For more information on Louisville, Ky attorney Mike Schafer go to <a href="http://mikeschaferlaw.com/" target="_blank">www.mikeschaferlaw.com</a>.]]></description>

		<title>Motorcycle Accident Takes Life of Louisville Man</title>

		<title>Woman Killed in Hit and Run Near Southside Drive</title>
		<description><![CDATA[Saturday evening a pedestrian was killed near the intersection of Southside Drive and Kingston Avenue.&nbsp; The 49-year old woman has been identified as Maria Ndimuzigo.&nbsp; Ms. Ndimuzigo lived in the 100 block of Kingston Avenue which is only blocks from the site of the accident.<br /><br />The accident occurred around 8:20. The victim was taken to University Hospital where she was pronounced dead at 9:07.&nbsp; The cause of her death is multiple blunt force injuries.<br /><br />The vehicle that hit Ms. Ndimuzigo did not stop.&nbsp; Police are looking for a maroon vehicle that was last seen traveling north on Southside Drive. 		<title>Crash on I-64 Kills Man From Owensboro, Kentucky</title>
		<description><![CDATA[Yesterday at around 11:50 a.m. an accident on I-64 and Blankenbaker Parkway in Louisville, Kentucky&nbsp; caused the death of one and injuries to another.<br /><br />Police are still investigating the automobile/truck accident and it&rsquo;s causes.&nbsp; The crash did involve two cars and a tractor-trailer.&nbsp; John Ward, a 26-year old from Owensboro, Kentucky was the driver of one of the cars and died at the scene.&nbsp; The other injured person was the passenger in Ward&rsquo;s car.&nbsp; The driver of the tractor-trailer and the occupants of the other car were not injured.<br /><br />Because of the crash, that part of the interstate had to be shut down for hours to allow for preliminary investigation and clean up after. 		<title>Young Woman Killed in Motorcycle Crash</title>
		<description><![CDATA[<p>In a motorcycle crash that occurred Tuesday evening 19-year-old Heather Jaggers was killed.</p><br />
<p>Ms. Jaggers was thrown from a motorcycle which she was a passenger at the time of the accident. She was taken to University Hospital where she later died as the result of multiple blunt force injuries. She was not wearing a <a href="http://www.mikeschaferlaw.com/blog/fatalities-on-kentucky-roadways.cfm" target="_blank">helmet </a>at the time but motorcycle accidents can be fatal even if a helmet is worn. The accident happened around 8:30 near the intersection of Outer Loop and Nash Road in Louisville, Jefferson County Kentucky and involved another car. The driver of the motorcycle also sustained injuries when he was thrown from the motorcycle but they reportedly are not life-threatening. The driver of the car was injured as well and his injuries are also reportedly non-life-threatening.</p><br />
<p>Witnesses reported to the police the motorcycle riding westbound on Outer Loop when it collided with a car trying to turn left onto eastbound Outer Loop. According to the police charges against the motorcycle driver are pending. Results from the toxicology reports need to be reviewed.</p><br />

		<title>Husband Charged With Manslaughter After Crash Killed His Wife</title>

		<title>Louisville Bicyclist Dies After Being Struck</title>

		<title>Two Motorcycle Accidents in Kentucky Over the Weekend Claim the lives of Two Men and One Horse</title>
		<description><![CDATA[In two separate motorcycle accidents over the weekend in Kentucky two men have lost their lives.<br /><br />Edward Garner died on Saturday night in Madison County when apparently his motorcycle left the road and hit an embankment.&nbsp; He was transported to Pattie A. Clay Medical Center where he later died as a result of the injuries from the accident.&nbsp; Mr. Garner was 50-years-old and&nbsp; from Richmond, Kentucky.<br /><br />In a separate accident in Carlisle county 44 year-old Garrett Warfield was also killed while riding a motorcycle.&nbsp; Mr. Warfield was carrying an 11 year old passenger at the time of the accident who suffered injuries to her lower extremities.&nbsp; She was transported to a hospital in Missouri. The accident occurred when the motorcycle hit a horse on Kentucky Route 8-49 West.&nbsp; The horse also died in the crash.&nbsp; It has not been reported as to whether any of the victims were wearing helmets. <br /><br />With the price of gasoline rising I have seen more and more motorcycles and scooters on the road lately.&nbsp; It is the responsibility of all on the road to be aware of others. 		<title>Woman Killed and Toddler Injured on Interstate 64</title>
		<description><![CDATA[Monday night a 21-year-old woman identified as Christina Hughes was killed on I-64 near the Watterson Expressway, in Louisville, Jefferson County, Kentucky.&nbsp; She was traveling west on I-64 when she lost control of her car, the car then overturned. Ms Hughes was pronounced dead at the scene.&nbsp; Also in the car was a three year old child who was transported to Kosair Children&rsquo;s Hospital.&nbsp; The child&rsquo;s condition has not been released.&nbsp; An investigation is pending but it can be noted that police are looking at whether speed may have been a factor in this fatal accident.&nbsp; It has not been reported as to whether Ms. Hughes was wearing a seat belt at the time of the accident or what kind of restraints the child may have been in at the time of the accident.<br /><br />Interstates are dangerous places.&nbsp; You have several vehicles weighing tons traveling at speeds of 55 miles per hour and usually faster than that.&nbsp; Automobile accidents are devastating and even more so when someone has lost their life.&nbsp; Having represented families who have lost a loved ones in an vehicular fatalities I am always reminded that as much as you can control what you do on the highway you have no control of what others do.&nbsp; The best route is to exercise every safety measure available to you. 		<description><![CDATA[On Tuesday afternoon around 3:30 a woman riding a bike down Bardstown Road near the Grinstead Drive intersection was struck by a passing van and was transported to the hospital.&nbsp; Both the van and the bicyclist were in the right hand lane traveling south.&nbsp; The identities of both the driver and the injured woman have not been released.&nbsp; It has not been reported as to whether the woman was wearing a helmet at the time of the accident.&nbsp; The investigation is still on-going which will include, among other thing, toxicology tests.&nbsp; No charges have been filed against the driver of the van.<br /><br />Many people don&rsquo;t realize that there are several <a href="http://mikeschaferlaw.com/blog/bicyclist-killed-on-jefferson-county-kentucky-road.cfm" target="_blank">rules</a> for both bicyclists and motorists that are intended to insure the safety of the many cyclist on Kentucky roads.&nbsp;One of the rules for cyclists is they must use the bicycle lane if there is one available.&nbsp;The Kentucky Driver's Manual suggests that a &nbsp;motorist&nbsp;when passing a cyclist should only pass when there is at least three feet between their vehicle and the cyclist.&nbsp; It should also be noted that bicyclists are not allowed to ride on the sidewalks.<br /><br />As a bicyclists myself I have had many instances where vehicles have come very close to hitting me.&nbsp; I urge all drivers to be careful and aware of bicycles on the road. Both the cyclist and driver of a motor vehicle must obey the same rules of the road. By doing this and being aware of the presence of others on the roadways many of these accidents can be prevented. 		<title>Ways to Avoid Fatigued Driving</title>
		<description><![CDATA[Driving while fatigued, just like driving under the influence of alcohol or drugs, can be hazardous and can lead to an auto accident.&nbsp; When a person is sleepy their reaction time is slower, their awareness is less acute, judgement is impaired and in some cases the driver experiences increased aggression.&nbsp; All of these factors indicate a dangerous driver.&nbsp; The National Highway Traffic Safety Administration has reported that fatigue is the cause of almost 100,000 accidents every year.&nbsp; Of those 1,500 people are killed in these accidents and 71,000 are injured.&nbsp; There are ways to <a href="http://www.edmunds.com/ownership/safety/articles/119330/article.html">prevent</a> falling asleep while driving. <br /><br />&bull;&nbsp;&nbsp;&nbsp; Stop driving if you feel sleepy.&nbsp; Drink a caffeinated beverage but wait 30 minutes or so before taking the wheel again.&nbsp; That&rsquo;s how long it takes for the caffeine to enter the bloodstream..&nbsp; You may use that 30 minutes to take a short nap.<br />&bull;&nbsp;&nbsp;&nbsp; Get lots of sleep the night before taking a long trip.&nbsp; The more the better.<br />&bull;&nbsp;&nbsp;&nbsp; Don&rsquo;t plan on working all day then driving all night<br />&bull;&nbsp;&nbsp;&nbsp; Drive at times when you are normally awake.<br />&bull;&nbsp;&nbsp;&nbsp; Avoid driving at &ldquo;sleepy times&rdquo; of the day.&nbsp; Take a middy break for a short nap and find a place to sleep between midnight and dawn.<br />&bull;&nbsp;&nbsp;&nbsp; Avoid foods that are high in carbohydrates, they can make a person sleepy.&nbsp; Opt for foods with high protein levels.<br />&bull;&nbsp;&nbsp;&nbsp; Avoid medications that make you sleepy such as cold and flu medications.<br />&bull;&nbsp;&nbsp;&nbsp; When driving long trips keep an awake passenger in the front seat with you.&nbsp; A loud radio is no substitute for actual conversation.<br />&bull;&nbsp;&nbsp;&nbsp; Take a break every tow hours or so even if you feel you don&rsquo;t need it.&nbsp; Get out of the car and take deep breaths and maybe some stretching exercises.<br />&bull;&nbsp;&nbsp;&nbsp; Try to set a limit of 300 to 400 miles a day.<br /><br />No matter how a person is impaired an impaired driver can make mistakes that can cause severe injury or death to the driver, passengers and even strangers.&nbsp; Always be aware of how you feel and be responsible for your actions. 		<title>Sleep Related Crashes</title>
		<description><![CDATA[Three years ago in Wisconsin a bus carrying high school students crashed<br />into an overturned tractor trailer killing five people.&nbsp; The National<br />Transportation Safety Board investigated the crash and determined the<br />driver of the tractor trailer had fallen asleep while driving.&nbsp; He<br />drifted off the side of the road then swerved to get back onto the<br />highway causing his rig to overturn.&nbsp; The bus traveling behind the<br />truck was not able to avoid the accident and crashed into the truck.<br /><br />The NTSB has suggested that trucking companies work harder insuring<br />their drivers get adequate rest while traveling long distances on the<br />road.&nbsp; They have asked the Federal Motor Carrier Safety Administration<br />to be more aggressive in insuring the trucking companies records are<br />kept up to date as well as the drivers diligently filling their log<br />books.&nbsp; A driver is allowed to drive for 11 hours only after 10 hours of<br /><a href="http://www.fmcsa.dot.gov/rules-regulations/topics/hos/hos-2005.htm">off duty time</a> and their <a href="http://www.fmcsa.dot.gov/documents/eta/logpage.pdf">log book&nbsp;</a> is a record of their time on the road, off the road and sleeping times.<br /><br />There is also technology in the very early stages that may reduce<br />fatigue induced crashes.&nbsp; An dash mounted camera is in the works that<br />will track eye and eyelid movement and will sound an alert if the driver<br />appears to be nodding off.&nbsp; Since drivers are often not aware of their<br />fatigue this could be beneficial.&nbsp; Several luxury cars now have similar<br />options available for their cars<br /><br />So many automobile accidents are the result of a drivers lack of<br />responsibility.&nbsp; It is the drivers responsibility to drive only when<br />rested and to not drive when they are fatigued. <br /><br />For more information on Louisville, Kentucky attorney Mike Schafer go to<a href="http://mikeschaferlaw.com/"> www.mikeschaferlaw.com</a>.]]></description>

		<title>Fatalities on Kentucky Roadways</title>
		<description><![CDATA[The week of September 15 through September21 was deadly on Kentucky<br />roads.&nbsp; Statistics out of Frankfort, Ky indicate that seven people died<br />in seven different accidents.&nbsp; the fatalities occurred in Hancock,<br />Hopkins, Mason, Pike, Trimble, Union and Jackson Counties<br /><br />Five of the crashes were motor vehicle accidents and four of the victims<br />were not wearing seatbelts.&nbsp; So far this year there have been 409 motor<br />vehicle fatalities on the roads of Kentucky.&nbsp; Of those 409 fatalities<br />254 of the victims were not wearing seatbelts.<br /><br />There was one motorcycle fatality during this time period.&nbsp; The victim<br />involved was not wearing a helmet at the time of the accident.&nbsp; There<br />have been 70 motorcycle fatalitiies so far this year and of the 70<br />victims 43 were not wearing helmets.<br /><br />There was also one ATV accident where the victim crashed into a barbed<br />wire fence. The victim was not wearing a helmet at the time and alcohol<br />use is suspected in this accident.&nbsp; This year the number of ATV<br />fatalities is 18 and 17 of those victims were not wearing helmets.<br /><br />This year in Kentucky there have been a total of 545 fatalities on<br />Kentucky roads but that is dowm by 82 from 2007.&nbsp; Of the 545 fatalities<br />only 108 have been the result of alcohol use.<br /><br />The week of July 28 through August 3 of this year was also a deadly week in Kentucky.&nbsp; There were <a href="http://mikeschaferlaw.com/blog/several-deaths-on-kentucky-roadways-end-july-and-start-august.cfm">16 fatalities on Kentucky roads</a>.&nbsp; Twelve of the 16 were motorvrhicle accidents, nine of the victims were not wearing seatbelts. Two were ATV accidents and neither of those victims were wearing helmets. 		<description><![CDATA[Monday evening around 6:00 p.m. a man was hit by a TARC bus while crossing the street at 4th Street and Market Street.&nbsp; Wednesday morning at the same intersection a woman was also struck by a TARC bus.&nbsp; The conditions of the victims have not been released but both were transported to the hospital with injuries.&nbsp; Neither of the victim&rsquo;s identities has been released as investigations are still on going. <br /><br />The accident that occurred on Monday evening has investigators relying on physical evidence to determine what exactly happened.&nbsp; Initially, witnesses as well as the driver of the bus, claimed the victim was not paying attention and was not in the crosswalk when the accident happened.&nbsp; Since then another witness, a passenger on the bus at the time of the accident,&nbsp; has come forward and said the victim was clearly in the crosswalk when the bus struck him.&nbsp; Also, one witness said the bus tried to stop before striking the victim while the other witness has said that there was no attempt to stop the bus. <br /><br />A TARC representative has said that all drivers are trained on pedestrian safety particularly in areas where there is a high concentration of pedestrians.&nbsp; The intersection of 4th and Market Streets is one of those areas being that it is in front of the convention center.&nbsp; Before this week there have been three pedestrians hit this year by TARC busses. <br /><br />&nbsp;Having represented pedestrians that have been hit by cars and busses in the past I know the severe damage that can be done by this type of accident. 		<title>Louisville Metro Police Officer Involved in Crash</title>

<p class="MsoNormal">There are a few different names for traumatic brain injury; it can also be called acquired brain injury or just a head injury.<span>&nbsp; </span>The cause of these injuries to the brain is a sudden trauma which causes damage to the brain.<span>&nbsp; </span>This can happen when the head is suddenly hit with force, like in an auto accident, or when an object damages the brain tissue by piercing the skull. When in a rear end automobile accident the motion that propels the head can cause the brain to come into contact with the inside of the skull and cause a mild close head injury.<span>&nbsp; </span></p><br />
<p class="MsoNormal">&nbsp;</p><br />
<p class="MsoNormal">The symptoms of traumatic brain injury can range form mild to severe. A person who is experiencing a mild case of traumatic brain injury may lose conscious for a few seconds or even minutes.<span>&nbsp; </span>Other symptoms may include headaches, confusion, dizziness, vision problems, fatigue, ringing in the ears, changes in sleep patterns, memory and attention issues.<span>&nbsp; </span>These same symptoms can also be seen in a person with more moderate and severe brain injuries but may also have nausea, convulsions, not having the ability to wake up, slurred speech, dilated pupils, and numbness in arms or legs.<span>&nbsp; </span>There are many other symptoms. If you think you may be experiencing any of these symptoms it is very important to get it checked out by a physician.</p><br />

<p class="MsoNormal">If there is a diagnosis of traumatic brain injury the treatments will vary depending on the severity of the injury.<span>&nbsp; </span>There may not be a lot that can be done to reverse the brain injury caused by a traumatic event.<span>&nbsp; </span>What medical personnel will do is try to stabilize the patient to prevent further injury.<span>&nbsp; </span>They will make sure there is enough oxygen getting to the brain as well as insuring adequate blood flow throughout the body. X-rays will also be administered to check for fractures and spinal issues and for more severe instances a computed tomography (CT) scan will be administered.<span>&nbsp;&nbsp; </span>Treatment is highly individualized and will be based on the needs of the patient.<span>&nbsp; </span>These may include physical rehabilitation, therapy for speech, occupational therapy as well as psychiatry and various social supports.</p><br />

		<title>What is a Bulging Disk?</title>
		<description><![CDATA[A bulging disk is a condition that manifests in the spine.&nbsp; Bulging disks usually occur in the lower part of the back or&nbsp; the lumbar region. The condition involves a disk that bulges through an opening in the spine.&nbsp; Occasionally bulging disks can affect the neck as well.&nbsp; Disks serve as a cushion for the vertebrae of the spine and are composed of a soft gelatinous material.&nbsp; Usually, but not always,&nbsp; a bulging disk is the result of aging.&nbsp; Another cause of a bulging disc is a traumatic occurrence. This can be anything from a fall to an auto accident. The disk can shift out of its normal radius and can cause pain.<br /><br />Bulging disks differ from herniated disks in that they usually develop over time while a herniated disk is the result of an immediate trauma or injury to the spine.&nbsp; Commonly there is no pain associated with a bulging disk unless it becomes herniated or ruptures.&nbsp; Because it doesn&rsquo;t cause pain it often goes unnoticed and undiagnosed.&nbsp; It can be diagnosed as a secondary condition and detected only through routine magnetic resonance imaging (MRI) tests. 		<title>Bicyclist Killed on U.S. Highway 25 in London, Kentucky</title>
		<description><![CDATA[26-year-old Chris Powers of Jonesboro, Illinois was killed while cycling in Laurel County on Sunday evening, August 31, 2008.&nbsp; Powers was riding with another bicyclist when a Kentucky State Trooper, Chris Roberts, while responding to a call hit both cyclists resulting in the death of Powers and the other rider suffering only minor injuries.<br /><br />The investigation showed that a white Plymouth was preparing to make a right turn but stopped suddenly to avoid the cyclists.&nbsp; Trooper Roberts was behind the Plymouth when it stopped suddenly and swerved to the right hitting both of the bikers.&nbsp; Powers was pronounced dead at the scene.&nbsp; The investigation is still on-going but investigators say it initially appears to be a tragic accident.<br /><br />This bicycle fatality was one of 13 who were killed on Kentucky roadways during the Labor Day holiday weekend.&nbsp; Nine of the crashes were involving automobiles in which the victims were not wearing seatbelts.&nbsp; There was also a motorcycle crash as well as an ATV crash in which none of the victims were not wearing helmets.<br /><br />Careful driving is the safest driving but during holiday weekends the is particularly true.&nbsp; There is a higher volume of traffic on the roads therefore more of an opportunity for accidents.&nbsp; For more information on Louisville, Ky attorney Mike Schafer go to <a href="http://mikeschaferlaw.com/">www.mikeschaferlaw.com.</a>]]></description>

		<title>Two Separate Overnight Hit and Runs Kill One and Critically Injure Another</title>
		<description><![CDATA[Friday night, August 29 was a dangerous one for pedestrians in the Louisville, Ky area. The first incident apparently occurred in New Albany, In. when 51-year old Jerry Payne was crossing Charlestown Road just before 9 p.m. He was it by a vehicle traveling north which did not stop and render aid. He was transported to University Hospital where he is apparently in critical with injuries that are considered life-threatening. The vehicle involved was later found, according to the Indiana State Police. The driver has still not come forward. According to the police the driver has indicated to his family that he will turn himself in later today.<br /><br />On the other side of the river, much later, another man was hit while crossing Market Street between Sixth and Seventh streets in Louisville, Kentucky. As a result of the injuries the man died. The identity of this <a href="http://mikeschaferlaw.com/practice_areas/wrongful-death-and-fatal-accidents.cfm">fatal accident</a> victim has not been released. The car hitting the pedestrian did not stop but fled eastbound on Market Street. Fortunately there was a metro police civilian crime scene technician close by and heard the accident and recognized the car as what may be a blue Chrysler PT Cruiser with possibly a red team flag attached.<br /><br />As we have taught our kids from the beginning it is important to look both ways before crossing the street. 		<title>Several Motorcycle Fatalities in Kentucky Counties in Past Week</title>
		<description><![CDATA[<span style="font-family: arial,helvetica,sans-serif;">The week of August  18, 2008 to August 25,  2008 was a deadly one for motorcyclists on Kentucky roads.<span>&nbsp; </span>The accidents occurred in several different counties throughout the state.<span>&nbsp; </span>Included in these counties are in Fleming, Garrard, Laurel, McLean and Menifee counties. The last of the counties is Woodford  County where 44-year old Clinton Brown died while traveling on Old Frankfort Pike.<span>&nbsp; </span>Apparently he lost control of his motorcycle while navigating a curve, left the road and hit several trees.<span>&nbsp; </span>He died at the scene from head injuries.<span>&nbsp; </span>It has not been reported as to whether he was wearing a helmet or not. <br /></span><br />
<p class="MsoNormal"><span style="font-family: arial,helvetica,sans-serif;">So far this year in Kentucky there have been 63 motorcycle fatalities.<span>&nbsp; </span>That seems like an extraordinary high number but statistically it is not.<span>&nbsp; </span>In 2007 there were according to <a href="http://www.kentuckystatepolice.org/hsp/pdf/motorcycle_fact_sheet.pdf">Kentucky State Police</a> 1,965 different motorcycle collisions which resulted in 105 deaths.<span>&nbsp; </span>On the national level there were 4,810 motorcycle fatalities.</span></p><br />

		<title>Thomas E. Murphy, Ironman Triathlete, Files Suit Against Many Organizations</title>
		<description><![CDATA[&nbsp;<br />
<p class="MsoNormal">On Monday, August 25<sup>th</sup> Thomas E. Murphy filed a lawsuit against Oldham Fiscal Court, the Police Department, and several others claiming they did not provide protection for bikers competing in the 2007 Ford Ironman Triathlon.<span>&nbsp; </span></p><br />
<p class="MsoNormal">&nbsp;</p><br />
<p class="MsoNormal">Also named in the lawsuit are World Triathlon Corp., USA Triathlon, the Greater Louisville Sports Commission, former Oldham  County police Officer Gerald Colston, the Oldham County sheriff&rsquo;s office, the cities of LaGrange and River Bluff, and Sondrah S. Laden of Prospect.<span>&nbsp; </span>Ms. Laden is the driver of the van that collided with Murphy during the race.</p><br />
<p class="MsoNormal">&nbsp;</p><br />
<p class="MsoNormal">As a result of the collision at the intersection of U.S. 42 and Locust Circle, Mr. Murphy suffered five broken vertebrae and a head injury.<span>&nbsp; </span>According to Lt.   Col. Billy Way of the Oldham County Police Ms. Laden apparently did not see the police directing traffic at this intersection at the time of the accident and saw that the traffic light was green and proceeded through, hitting Murphy.</p><br />
<p class="MsoNormal">&nbsp;</p><br />
<p class="MsoNormal">The Ford Ironman Triathlon consists of the athletes swimming 2.4 miles, biking 112 miles and running a marathon (26.2 miles).<span>&nbsp; </span>Last year was the first year that part of the biking portion traveled through Oldham  County on state roads.<span>&nbsp; </span></p><br />

		<title>Whiplash Injuries, Causes and Possible Treatments</title>
		<description><![CDATA[<br /><br />Whiplash occurs when the soft tissues of the neck are injured by a sudden jerking or &ldquo;whipping&rdquo;of the head. This type of injury is associated with rear end auto accidents. Whiplash is also referred to as a soft tissue injury. This motion will strain the muscles and ligaments of the neck beyond the comfortable range of motion.&nbsp; The ligaments in the neck, although smaller, are similar to those in your knee or ankle. Anyone who has ever injured their knee or ankle knows how painful it can be and the length of time it can take to heal. This can be several months or even longer. <br /><br />Anyone who has been in a car wreck can understand how whiplash can happen.&nbsp; When a car is stopped suddenly or is hit from the rear the seatbelt will keep the torso from being thrown forward while the head will forcefully go forward and then back.<br /><br />Symptoms of whiplash are pain and stiffness in your neck, also there may be pain in the surrounding muscle groups, arms, chest, and shoulders.&nbsp; As for treatment doctors will recommend over the counter pain relievers, light activities for a few weeks.&nbsp; This means no heavy lifting, sports or any activity that may cause more strain to your neck.&nbsp; In some cases doctors may prescribe muscle relaxants for a short period and possibly a neck collar.&nbsp; <br /><br />If you have been in a car accident it is always a good idea to have a doctor check you out.&nbsp; You may have injuries that you don&rsquo;t realize are there.&nbsp; Some injuries don&rsquo;t immediately show up, they may take a few days to manifest.&nbsp; Some symptoms that will need medical attention are recurrent neck pain and stiffness.&nbsp; Radiating pain in your arms and shoulders as well as weakness, tingling or numbness.&nbsp; Also, if you have pain when you move your head. 		<title>River Road Motorcycle Fatalities Identities Released</title>
		<description><![CDATA[The identities of the two motorcycle crash victims were released earlier today.  The accident occurred on <a href="http://mikeschaferlaw.com/blog/two-killed-in-motorcycle-accident-in-eastern-jefferson-county-kentucky.cfm">River Road</a> in eastern Jefferson County, Kentucky.  They are 42-year-old Dewon Thompson and 43-year-old Bobby Burton.  They were pronounced dead at the scene and had apparently died from multiple blunt force injuries.<br /><br />River Road is a beautiful road to travel in the day time but once it gets dark is can become treacherous.  It is not well lit, has many curves and is fairly narrow.  There are no emergency lanes to give added space to regain control of your vehicle if needed. 		<title>Two Killed in  Motorcycle Accident in Eastern Jefferson County, Kentucky</title>
		<description><![CDATA[It has been reported that at approximately 2:30 a.m. August, 25th two motorcyclists were killed on River Road in the eastern part of Jefferson County Kentucky.&nbsp; There were no witnesses to the accident but it seems that the two motorcyclists were traveling at a high rate of speed, possibly racing when they came upon a curve .The curve at River Road and Rockledge Drive is where the lost control of their motorcycles and left the road.&nbsp; They were both&nbsp; thrown from their motorcycles, one hit a tree as he was thrown.&nbsp; They were both pronounced dead at the scene.<br /><br />Not many details have been released yet but there are reports that the two were at Captain&rsquo;s Quarters, a popular dinner/bar on River Road, earlier in the evening.&nbsp; It has also been reported that neither of the cyclists were wearing helmets.&nbsp; The identities of the cyclists have not yet been released.&nbsp; <br /><br />&nbsp;For more information on me, an attorney in Louisville, Ky, go to <a href="http://mikeschaferlaw.com/">www.mikeschaferlaw.com.</a><br />]]></description>
