

It has been reported that an accident involving a motorcycle and a Kia Rio resulted in the death 47-year-old man who was driving the motorcycle. The accident occurred in the 1200 block of Gilmore Lane in Louisville, Jefferson County, KY on Monday August 11, 2008 somewhere around 7:45 PM. According to police the driver of the Kia Rio was headed east on Gilmore Lane and making a left hand turn into a parking lot and pulled in front of the motorcycle striking it. The motorcycle was coming in the opposite direction.The driver did not see the motorcycle according to what police reported.
The driver of the motorcycle has been identified as Michael Milligan. Mr Milligan was taken to University Hospital where he died of multiple blunt force injuries that were the result of the wreck according to a deputy Jefferson County coroner. It was also reported that Milligan did not have a helmet on when the crash occured.
The driver and passenger of the Kia Rio were not injured and have not been identified at this point. There is no suspicion of alcohol or speed as being contributing factors in this accident and no criminal charges are expected to be filed.
Failure to where a helmet while riding a motocycle could be considered a contributing factor in any injury sustained in a motorcycle accident. The car that caused the accident is still responsible for any damages that result from the collision. The percentage of the injury that would not have been sustained if there was a helmet being worn at the time of the accident would be deducted from the total personal injury settlement.
