Child Burn Victim Finally Gets His Day In Court

On December 30, 2005 then 11 year old Trevor Dennis was severely burned by an allegedly defective heater manufactured by the Coleman company. Trevor's family was using the Coleman heater in their camping trailer when the heater malfunctioned destroying the trailer and severely burning Trevor. His burns require ongoing medical care. "This appears to be a case of a manufacturer using a faulty design, sub-par critical parts and inadequate quality control leading to the catastrophic injury of a then 8-year-old boy," said John Bisnar of Bisnar Chase, Trevor's attorneys.

A California Superior Court will begin hearing the case against The Coleman Company starting Monday, November 2, 2009. What is disturbing is the length of time it has taken this case to come to trial. It has been nearly four years since this accident. Trevor and his family have had to endure the pain and agony of dealing with his burns and treatment for them as well as the stress that goes along with being involved in the legal process. Coleman has not accepted responsibility for the injuries caused. I hope that the family will get the closure they need this week at trial.


Trevor will get his day in court as he stands up to the Coleman company for what he believes is right. We will keep an eye on this David v. Goliath battle and see what the outcome is of this products liability case. This is what our jury system is all about in the United States. It is an opportunity for Trevor  to be placed on a even and level playing filed against a corporation and have his day in court before an impartial jury. Best wishes to the Dennis family.

Type:  Louisville Zoo train derails causing injuries to 22

 

Late this afternoon one of the three trains at the Louisville Zoo derailed in the Gorilla forest.  The train’s engine and three cars were turned on their sides.  Thirty minute later 22 people were taken to two different hospitals.  The ages of the injured victims range from two months old to senior citizens.  The injuries range from cuts and bruises to more serious injuries.  One person who was trapped is listed in serious condition and another who is being evaluated for a potentially serious head injury.  The Department of Agriculture is investigating the accident.

Travel Tips Not Just For Spring Break-Travel Tips From Louisville, Kentucky Attorney

Although it is that time of year, spring break, there are some things to remember when you are setting out on any trip.  Taking a few precautions in advance can certainly help when the unexpected occurs.  None of us ever plan for accidents, injuries, sicknesses, or other inconveniences when we are planning our trips.  We can still be prepared.

If you are traveling by car it is a good idea to look on one of the online weather channels to see if there are any weather alerts along your route.  If there is inclement weather on the horizon you may want to alter your route or delay your start.  Many cars are equipped with GPS capabilities and they are great.  It is also a good idea to have a regular map or atlas in your car in case something happens and your car’s system malfunctions.  You should also give your vehicle the once over before departing which includes checking out all belts, hoses, fluid levels, spare tire and tires on the car.  A few other tips are listed below

•     Pack tools, a cellular phone, a first aid kit, a flashlight, an roadside assistance card, fire extinguisher, water and snacks in the unlikely event your car breaks down.

•     Remember to bring your health insurance card as well as proof of car insurance.  Your registration should always be in your vehicle.

•    Be aware of where the hospitals and medical facilities are in the area you will be visiting.

•    Let your family and trusted friends know when you are leaving, when you’ll get back.

•    If you are traveling by bus, rail or air, don’t bring magazines with your name and address. Tear off your address label or mark it out. You do not want people who know that you are away from home to know where you live.

•    Don't have your name and address highly visible on your luggage for the same reason. If you have a business card use that as identification on your luggage.

•    Be aware of pickpockets who prey on people in crowds. They get close and bump into you without you noticing. Pickpockets also work in groups. One will distract while the other slips away with your goodies.

•    If you stop at a restaurant, bar or café and set your bag down, put your foot through the strap. That way it won't be taken without you knowing. Also, you'll remember to take it with you when you trip over it as you leave.

Taking a little more time in advance could save you time and headaches. Be safe on the roads.

In Fayettville, Arkansas in a Ponzi  styled scheme two men invested in the company Stoam Holdings. Stoam Holding sells  Stoam which is  a material claiming to have the insulation qualities of foam but the strength of steel.  The case ended up going to trial and the two investors were awarded $12 million dollars.  A new trial has been requested by the owner of Stoam Holding due to information that has surfaced pertaining to one of the jurors.  Jurror Johnathan Powell had posted eight message on Twitter  during the trial about the trial. There has been no ruling yet.

I have told both of my teenaged daughters to be very careful about what they post on their social networking sites (Twitter, Facebook, Myspace, etc) The information they are publishing could be seen by people it is not intended for.  This case is a perfect example of how information posted and end up in the hands of people it was not intended for.  If it is not information you are comfortable with the world knowing just don’t post it!

Senior Citizens are Safer on the Road

We have all complained about old people on the roads.  It seems that anytime we are in a hurry there will inevitably be a senior citizen on the road in front of us.  Instead of complaining about their slow driving be thankful they are slowing down and being more cautious.

I just added a news article to my website with some truly enlightening information.  It seems that older citizens are statistically safer behind the wheel than they used to be.  There are several reasons for the decline in the number of injuries and deaths associated with senior citizens and auto accidents.

•    They are limiting their driving to safer conditions and circumstances.
•    With the addition of turn-arounds and left hand turning lights intersections that were once dangerous are less so now.
•    Safer cars
•    Increased use of seatbelts
•    Driving programs for seniors

Having said all of this know that each individual is different.  If you know of a senior citizen who is not a safe driver please encourage to give up their keys.  There are several services the provide taxi services to seniors.  These make that act of giving up the keys a bit easier.

Ignition Interlock Systems in Place to Prevent Drunk Driving Accidents

In an effort to reduce drunk driving six states, Alaska, Colorado, Illinois, Nebraska, Washington and South Carolina, will start the year by requiring persons who have been convicted of drunk driving to install ignition interlock systems.  These systems, once installed, will prevent a car from starting until the drivers blow into the alcohol detectors to prove they are sober.
 
There are many states that have ignition interlocks available as a possible penalty for repeat DUI offenders but starting this week Alaska, Colorado, Illinois, Nebraska and Washington will require the device for all first time drunk driving convictions.  South Carolina began requiring them for repeat offenders the last week of December
 
The cost for the device is approximately $80 to install, $80 per month to rent and a $30 per month state fee. One of the flaws in this system is that the driver could have someone else blow into the system but if they are caught trying to circumvent they could go to jail.

One of the harshest critics of this program is the American beverage institute.  They agree with the program for repeat offenders and persons arrested with very high blood alcohol levels but fear that this program will create a country where people will no longer be able to have a beer at a ball game or a glass of wine with dinner.  Concern should also be on excessive speed and distracted drivers for causes of deadly accidents.

More Median Barriers to Prevent Crossover Car Accidents

The installation of median cable barriers that will prevent crossover
motor vehicle accidents continue to span onto more Kentucky highways thanks to an
announcement by Gov. Steve Beshear.  The cable barriers that have
already been installed on Interstates, 64, 265 and 71 in Jefferson and
Oldham as well as the one in Fayette County on New Circle Road have
apparently prevented almost 300 crossover car and truck accidents since
2006.
 
The five sections of highway are due for the cable installation were
determined by analysts who studied crash data to find the area with the
highest needs.  One of the areas getting the barriers is a 10.2 mile
stretch of the Gene Snyder Freeway between Interstate 65 and Dixie
Highway in the Louisville area. This is apparently the only area of the Gene Snyder Freeway
that doesn't have the barriers.  Other counties on I-65 that will
benefit from the barriers are Bullitt, Hardin, Hart and Barren counties.
These areas have been determined to be the most dangerous in Kentucky.

Medicare Pays Millions in Fraudulent Claims

It has been reported that Medicare may have paid up to $92 million since 2000 to medical suppliers who sent in bills for home medical equipment. According to investigators the doctors who names were used on the billing had been dead for up to five years.The Centers for Medicare and Medicaid Services (CMS) was advised of the problem some six years ago but has failed to correct the problem. Since 2000 they have apparently honored about 500,000 of these claims.

Last year, a Medicare Fraud Strike Force was established. It was hoped that it would help to solve the problem which it is estimated costs taxpayers tens of billions of dollars annually.

I believe this problem with fraudulent billing has made it more difficult to obtain reduction from CMS for individuals that have been hurt in motor vehicle accidents. Any money paid by Medicare for medical bills related to injuries sustained in a car accident must be reimbursed by the injured person if they receive a settlement or a jury award in their personal injury case. This lien or right to subrogation or reimbursement is primary and must be paid. With the fraud that  appears to be occuring I suspect that it will become more difficult to obtain reductions for deserving people who have been injured in automobile accidents.

Ambulance Involved in Fatal Accident Being Investigated by Jefferson County Grand Jury

It has been reported that an ambulance involved in a fatal accident in Louisville, Jefferson County KY three months ago is being inverstigated by the Jefferson County Grand Jury. Since the accident the Shively Police Department has uncovered details about the driver which may result in her facing criminal charges in Jefferson Circuit Court.

The accident occurred in April of 2008 when 54-year-old Vickie Whobrey was being transported to Caritas Hospital for a severe, continual nose bleed. The ambulance driver never made it to the hospital as it crashed at the intersection of Rockford Lane and VanHoose Drive. Tammy Brewer, the EMT driving the ambulance, claimed that she had to dodge a pedestrian. Interestingly, the Shively Police said back at the time of the crash that "No one was ever located by the police or anyone in that area or on the road." A witness who was traveling behind the ambulance, said that there was not a pedestrian in sight.

The investigation stems from several text messages sent by Brewer's partner to their supervisor on the date of the crash expressing concern about her behavior. In these messages her partner said that Brewer was "loopy" and indicated she was unable to drive. Her partner had asked the supervisor to meet them at the hospital to remedy the situation.

Bicyclist Assaulted by Motorist

Friday, July 25th Dan Cooley reported that he was assaulted on his way to work. For six months Cooley has been riding his bike to work at The Parkland Medical Center. The incident happened on Barret Avenue in the Highlands area in Jefferson County.


Cooley was riding when he was nearly hit by a motorist pulling out of a parking lot. According to Cooley "words were exchanged" At that point Cooley went to the sidewalk. The motorist went after him, hitting his bike and knocking him over. Cooley then said another passenger got out of the car and assaulted him by hitting him in the face.


Cooley’s injuries are not as bad as they could have been according to Cooley. As a result of the assault/accident he has a torn ligament.


With the road-rage reaching almost deadly proportion it is vital to keep you head in any situation. It is always best to do the hardest thing and that's to walk away. You can never be sure what is going on with the other person.

Car Accident Courts

If you are in an car accident and because of various circumstances you may find yourself having to go to court.  For many that can be  frightening and daunting.  A small percentage of the population are comfortable in the court system.  These are the folks that work there daily and are familiar with the processes.  Most are not familiar or comfortable with all of the intricacies of the judicial system.

There are different levels in the Kentucky court system.  The appellate level houses the Supreme Court and the Court of Appeals.  Trial Courts include Circuit Court and District Court.  Family Court is a division of Circuit Court. There also Specialty Courts which can be divisions of either Circuit or District Court.  These Specialty Courts are Small Claims Court, Juvenile Court, which are divisions of District Court.  In juvenile cases where the offenses are serious felonies the juvenile can be tried as an adult.  If convicted they will serve their time in a juvenile facility until they are old enough to be transferred to an adult facility.  Another Specialty Court is Drug Court which is a division of both Circuit and District Court.

When you are involved in a lawsuit as a result of an accident you will be either in Circuit Court or District Court.  The amount in dispute has to be more than $4,000.00 to fall in Circuit Court.  Less than $4,000.00 will fall in District Court.  If the amount is $1,500.00 or less you can take your accident case to Small Claims Court.  Small Claims is less formal and less expensive.  Also, parties involved in Small Claims actions are allowed to represent themselves without an attorney.

Whiplash Injuries, Causes and Possible Treatments



Whiplash occurs when the soft tissues of the neck are injured by a sudden jerking or “whipping”of the head. This type of injury is associated with rear end auto accidents. Whiplash is also referred to as a soft tissue injury. This motion will strain the muscles and ligaments of the neck beyond the comfortable range of motion.  The ligaments in the neck, although smaller, are similar to those in your knee or ankle. Anyone who has ever injured their knee or ankle knows how painful it can be and the length of time it can take to heal. This can be several months or even longer.

Anyone who has been in a car wreck can understand how whiplash can happen.  When a car is stopped suddenly or is hit from the rear the seatbelt will keep the torso from being thrown forward while the head will forcefully go forward and then back.

Symptoms of whiplash are pain and stiffness in your neck, also there may be pain in the surrounding muscle groups, arms, chest, and shoulders.  As for treatment doctors will recommend over the counter pain relievers, light activities for a few weeks.  This means no heavy lifting, sports or any activity that may cause more strain to your neck.  In some cases doctors may prescribe muscle relaxants for a short period and possibly a neck collar. 

If you have been in a car accident it is always a good idea to have a doctor check you out.  You may have injuries that you don’t realize are there.  Some injuries don’t immediately show up, they may take a few days to manifest.  Some symptoms that will need medical attention are recurrent neck pain and stiffness.  Radiating pain in your arms and shoulders as well as weakness, tingling or numbness.  Also, if you have pain when you move your head. These symptoms are your body’s way of telling you something is wrong.

All injuries can be serious but when looking at head, neck, or back injuries a person has to be extremely careful.  If not treated correctly they can cause huge problems in the future.
